-- not being charged, convicted, or punished for it afterward -- I will certainly make the argument that Christie is a criminal if it is confirmed that he has indeed done criminal things. Of course, there are degrees of criminality. What's unethical and what's immoral are set to a lower standard, with a different kind of punishment. As of now, it looks like Christie has done all of the above: acted illegally, unethically, and immorally.
As for my prediction, it looks as though the state-level investigation is already compromised. Thankfully, Christie was unable to promote his chief of staff to the position of attorney general (who could has easily squashed this whole thing months ago). But there is a member of the state "super"-investigative committee whose name has turned up in the emails, so he will be effectively investigating himself. But if Christie skates because the investigation is botched or rigged, that won't make him any less of a criminal in my eyes, either.
