(26,366 posts)WASHINGTON (Reuters) - A Virginia recount court on Wednesday rejected a bid by the Democratic candidate in a disputed state House of Delegates race to reconsider its ruling that the election had ended in a tie, Washingtons WTOP radio reported.
The Newport News Circuit Courts decision means that a lottery-style drawing will go ahead as planned on Thursday to determine the winner of the race between Democrat Shelly Simonds and Republican incumbent David Yancey.

(42,374 posts)That's because the House of Delegates will choose a speaker whether or not the contest over the disputed election is resolved.
Possibility One: The Democrat wins the draw, and the republican asks for another recount. The Democrat will not be seated until the recount is completed, which means the speaker will be selected by a House of Delegates that is 50-49 in favor of the repubs. (Not seating the "winner" if there is a recount is standard operating procedure since otherwise you could have legislation voted on by someone who ends up being the loser in the election).
Possibility Two: The republican wins the draw and the Democrat asks for another recount. The republican won't be seated pending the outcome of the recount, but the House will still be divided 50-49 in favor of the repubs when the House speaker is chosen.
Once the speaker is chosen, it takes a 2/3 vote to replace him or her. And the speaker wields a lot of power.

(42,374 posts)The one possibility, and I'm not sure whether or not this would be an available option, would be for the loser to demand that the House itself resolve who the winner is, which would be unfortunate since the 50-49 House likely would conclude the republican is the winner.

(26,366 posts)We made an offer to make the draw tomorrow final, which Yancey has declined. Just to be clear: no deal means all options are still on the table for us moving forward.

I will continue to fight. Yancey has declined my offer to make the draw tomorrow final, so I guess the only sure thing is that this won't be settled tomorrow. I'm sorry that my district may not have representation Jan 10 because of this.
