Hypothetically if the FBI discovered evidence of a crime during a background check

Would they not be bound to refer it to the justice department for prosecution or could they be told to ignore it because it's just "a background check" ?

in this administration a criminal past is a requirement.

2. Not talking about that.

The rank and file FBI agents have nothing to do with this administration. They were there before and will be there after. I would think that they follow procedures regardless of who is in power.
