Napolitano thinks Trump won't pardon Stone because he got half of the expected sentence. Bullsh*t.

In the wake of Roger Stone’s sentencing of 3.5 years in prison this Thursday, Fox News legal analyst Andrew Napolitano posited that U.S. District Judge Amy Berman Jackson’s choice to go along with Attorney General Bill Barr’s sentencing recommendation could have been an effort to pardon-proof the sentence from President Trump.

“[Jackson’s] trying to make this bulletproof from a pardon,” Napolitano said. “Because she went along exactly with what [Barr] requested.”

“How could the government possibly object to this?” he continued. “She gave them exactly what they wanted, and it’s half of the number that had outraged the President.”

The judge seems to have done this in part to make it more difficult for Trump to justify the pardon. Not that he needs any justification. As much as I hate to agree with anyone on Fox, I think it's an accurate assertion.

I think Stone still gets a pardon, but it's slightly more complicated now. It will also make Trump's inevitable blowup, then pardon, look worse than if a longer sentence had been assessed.

I'm usually wrong about these things, so I'm tooting my own horn on this one, forgive me ...

I'm not SURE he gets a pardon, by any stretch.

I'd be unsurprised either way, frankly.

But at the same time ... it's smart, yup.

As an aside, I know Judge Jackson is very smart, so that's why I suspected she'd go this route.

It's still kinda depressing to ponder though ...

...it gets to the point where he asks how the government could object, since the judge gave them what they wanted.

It's what Barr wanted...it's not what Trump wanted.

Stone knows that Trump never pardoned Manafort, who is older, sicker, and got a much longer sentence.
Stone in prison is useful for Trump: "He's a victim of the deep state and fake news!"


Everyone who has ever counted on Trump's loyalty and love has been disappointed, because he doesn't have any of that.

That there is a sound legal opinion that those with pardon power can't pardon someone who committed their crime on behalf of the person with the pardon power.

Roger Stone has the goods on Trump. If Trump allows Stone one day/night in prison, Stone will release some secrets.

There will be a pardon.
