AZ Republic: Sen elect Kelly could be sworn in by November

Its behind a paywall so I don't know the exact argument but since McSally's appointment was a temporary appointment Kelly becomes the Senator elect for that seat immediately and finishes the term and has to run again in 2 years.

Joy Reid reporting the same point on her show,

Kelly would fill the seat after AZ SOS certifies the election.

Only the Senate Majority Leader can allow that to occur.

And he'll be Majority Leader until January 2, even if the repubs lose the Senate.

Arizona law and they are quoting AZ legal experts.

Delaying the swearing in cannot invalidate AZ law.

The selection of replacement Senators is exclusively a matter for State law. Some are by appointment some by election.

Arizona allows for appointment but only until the next GE.
