I think the GSA is in violation of the law

She is holding up funds for the transition. At least based on this organization's website, she can't do that.

The law provides that an eligible candidate has the right to the facilities and services provided to eligible
candidates until the date on which the Administrator is able to determine the apparent successful
candidates for the office of president and vice president.

The GSA is supposed to be, and has been until now, independent and non-partisan of THE Government.

Seems we need to be calling our Dem reps and senators to get clarification on this ASAP. Team Biden needs every arrow possible in their quiver.

Answer, nobody. There's no LEGAL reason for the Transition Office to be authorized until there is one.

Election Certification dates:
PA - Nov 23
GA - Nov 20
NV - Dec 1
AZ- Nov 30

The funds should be available until Biden is demonstrated to no longer be an eligible candidate (that is the way the summary is phrased and should be phrased).

Maybe he is exercising soft power behind the scenes to keep the chaos down. I don't know. I think regular citizens pointing out the hypocrisy and dangerousness of this is the best approach (punch up and not down).

The Transition Act addresses support for candidates both before and after an election. Eligible candidates can receive certain facilities and services from GSA before the election is held; a different level of support applies after the election. The statement you quote merely indicates that if the election has been held but the outcome is uncertain, the candidate can continue to receive the facilities and services he/she was entitled pre-election.

They need to rewrite the law to better define President-elect or wait to see if the funds are released after the last certification to get Biden to 270.

I haven't plowed through it, but if what was happening now was in contravention of that MOU (or the statute itself), don't you think the Biden campaign would be formally citing one or both of those things in demanding GSA start the post-election transition process?

I'm constantly amazed by the number of times bloggers post things on the Internet that implicitly suggest they have a better understanding of the law than Biden and his team. And then other folks pick up on those blogs and unwittingly spread that message.
