Supreme Court justices can't be proactive; they have to wait for cases to come to them. AGs, however, can make things happen. Moscow Mitch might be sorry he blocked Garland's SCt nomination.

But if somebody needs prosecuting and there's a good case, he won't be afraid to do it.
