Or will they begin the great cover-up?
My hope is that they will let the country put this trauma behind us and let the Justice Department do its work.
They could make a quick decision or they could decide to not take the case at all. The Committee would be free to receive the White House documents from the National Archives.
Or they could choose to be political and let it drag on and on. They could decide that the best thing for the Republican Party, not necessarily the country, would be to cover it up by making it disappear.
Folks will be watching the Supreme Court very close in the next few weeks would be my guess.

Trump can't claim executive privilege because he's not President and even if he was, privilege can't be used to cover up a crime.
And, they probably want to know the skinny as much as the rest of us.

(110,950 posts)...but they have allowed themselves to become politicized much more than usual in the last few years, in my opinion.
Trump's supreme arrogance and boundless stupidity had him thinking all his appointees would be 'loyal' to him. SCOTUS justices may lean toward conservative politics and re-think some previous decisions like Roe, but they ain't going to be complicit in a scheme to overturn an election.

(2,234 posts)The Committee has requested SCOTUS make a decision in January. Regardless their present schedule, we KNOW they could drop whatever they're doing, long enough to render a decision to not take the case, assuming that's what they decide. IF they take that course of action, I'm probably right. If they don't, you can be looking for the crow to cook...
But I cannot believe any Justice on the Court is sympathetic, in any way to any degree, to Trump's insanity.
Justice matters.

Also how not allowing the committee to obtain probable evidence of possible crimes is not covering up.
To dismiss it is the easiest path.

(110,950 posts)That would be a mistake if they were to try that. A lot of people would be on their case all of the time if that were to happen. John Roberts would not want that.

Actually, I would think Gorsuch, Kav, & Barrett would also not want to be thought of as Trump toadys. He can't do anything to them. They have lifetime appointments.

In order to appear even-handed, I would not be surprised to see them rule against the mandates and against Trump, also, just to show they are not "playing politics".
