18 U.S.C. § 371—Conspiracy to Defraud the United States

"If two or more persons conspire either to commit any offense against the United States, or to defraud the United States, or any agency thereof in any manner or for any purpose, and one or more of such persons do any act to effect the object of the conspiracy, each shall be fined under this title or imprisoned not more than five years, or both."

Focus on the word defraud.

This is one federal statute under which, based on the evidence so far presented in the January 6, 2021, hearings, Trump (and possibly the Congressmen not yet mentioned in the hearings) can be prosecuted.

The first hearing focused on mens rea/actus reus and general intent (which is an element needed to successfully prosecute and hold someone culpable for fraud).

This second hearing is focused on the conspiracy to commit the offense ("Team Normal" v. "Team Schizo" ) .

I love the way that the evidence is being presented.
