Lawsuit: Cliven Bundy's Wandering Cows Allegedly Caused Car Crash

woman sued Nevada rancher Cliven Bundy for negligence since a cattle he let roam on public land caused her to crash her car, the Las Vegas Review-Journal reported.

In April, the Bureau of Land Management let Bundy use federal land for his cattle even though he hasn't paid grazing fees in years after an intense standoff between the rancher's militia and the federal government.

Just two days after the BLM released Bundy's cattle, multiple cows wandered onto an interstate highway, where one collided with a car. The crash killed the cow and seriously injured a Las Vegas woman. Danielle Beck filed a lawsuit on Sunday and said Bundy "recklessly, carelessly and negligently allowed his cows to enter onto Interstate 15 through an area where he had no grazing or other rights."

"It’s a state problem. It’s not our problem," Bundy told the Review-Journal. "We really feel bad when it happens. We sure don’t want it to happen. But we’re not liable."

Which means they are free to roam, and its your reponsibility to keep them out (or the state DOTs responsibility to maintain a highway fence.

If this was anybody but bundy I would agree with him that he is not at fault. If they can make a case that the cows were illegally grazing then they can probably show that Bundy has liability.

And others have fence out laws regarding livestock. I don't believe there is any fed law requiring livestock be contained.

I hope he drowns in his manure pit. I'm just saying not all laws require you to fence in your livestock

Freeway fences are maintained by the Nevada Highway Department. Any breaches in the fence will be a issue. BTW,can't remember if this stretch of I-15 is covered by Open Range Law. If it is,Ms.Beck might be crap out of luck. She,hopefully not,will have to pay the owner fair market value for the cow. Good Luck Ms.Beck hope you nail this sucker.

He's still trying to weasel out of it though; it's the teacher's fault for hitting his cow that he needed to control, and it's the government's fault for not keeping his cows fenced in.

If I don't want cattle on my land, I have to fence them out. About thirty years ago I hit a young black bull as I came out of a dip in the road. It was dead. It took everything my friend and I had to pull it off the road. I had just bought the truck days before.

though they don't do such a great job of it.

And that people driving out there are supposed to be on the lookout, so they don't run into stray cattle.

He pays his grazing fees, by the way, so he's not a fan of Bundy's.

Or at least in my neck of the woods anyway. Sometimes highways cut across migration trails. Wyoming put in over and under passes for migrating deer and pronghorn. I don't know about Nevada, the driver would be legally responsible for killing the cow.

A portion of those fees go to repair and maintain rangeland fences. Since Bundy refuses to abide by policies that would contribute to the safety and security of his stock, AND to the safety and security of the general public using the interstate in the affected area, he would have no standing in shifting blame away from himself and onto to the state or any other level of government. Bundy is left holding a bag that he managed to create for himself.

but the BLM don't care about game fences (it's more about deer than cows). But then, if it were state land, his bill would be a lot more than $1.35 per AMU.
