Gov. Abbott signs 'constitutional carry' bill allowing Texans to carry handguns without a permit

Gov. Greg Abbott has signed Texas’ “constitutional carry” legislation, allowing Texans over age 21 to openly carry handguns in public without a license starting Sept. 1.

The law, a huge win for guns rights advocates, was one of the most controversial measures passed this session. Bill supporters said the legislation would simply restore Second Amendment rights to law-abiding Texans, while critics have said the move will only lead to more gun violence.

Abbott signed the legislation Wednesday afternoon without immediate comment, per the state’s online bill tracker. His office sent out a media advisory shortly afterward, saying the governor would hold a ceremony in San Antonio on Thursday to sign off on several bills related to gun rights, including permitless carry.

The law will remove the state’s $40 fee to obtain a handgun license, and will also take away training requirements. While gun advocates say they aren’t against safety courses, they assert the training should be voluntary.

Please stop ignoring the part of the 2nd amendment that says "A Well Regulated Militia being necessary..."

Well Regulated does not mean every person who wants a gun.

He lost support over the limited COVID restrictions and was attacked on the Right and the Left. He knows he will lose absent cheating and solid Republican support. We are getting all of the extreme Right legislation for these reasons. Texas is turning blue and they are desperate to hold onto power.

Gun nuts are ok with shootings as a cost for playing with their favorite toys.

9. When Texas becomes a more Wild West shoot up place tourism will be hurt

Would you go to a state where anyone could buy a gun and you become an innocent victim?

My sister in law is a flight attendant and she had a layover in Amersterdam recently and someone she talked to asked her about how even crazies can get guns now. And said they have no desire to go to those states with so many guns.

They settle "debts" private and public.

Notice how I ignored the only if legal part?

If the 2nd Amendment can mean unrestrained gun ownership, and by extension gun use, to resolve perceived threats private and public, Police should stand down and allow the natural course of gun use regardless the outcome. It's Constitutional after all, hell it is even greater than that it is a universal truth unassailable by any law, logic, or consequence.

Over the next 96 minutes he shot and killed 15 people, including an unborn child and one final victim who died from his injuries in 2001. Whitman also injured 31 others. The incident ended when a policeman and a civilian reached Whitman and shot him dead. At the time, the attack was the deadliest mass shooting by a lone gunman in U.S. history, being surpassed 18 years later by the San Ysidro McDonald's massacre.

16. I'm going to go out on a limb and bet

they won't let me carry one into Abbot's office. But they expect me to walk around in public where other people are carrying them.

I'll never set foot in the state of Texas again. And it's really a shame, because it's it's been my experience that the people there are very nice and friendly. But I'm not comfortabel being around people carrying guns with no training or permitting process.

38. You may wish to take a look at the map in post #37. Around 80% of the country now allows

either concealed carry without a permit or automatically grants such permits unless one is a prohibited person (felon, domestic abuser, etc.).

This law doesn’t change that.

Federal law allows intrastate sales between two state residents absent a background check, this law doesn’t have anything to do with that, either.

A prohibited person, such as someone mentally ill, still cannot buy a gun in Texas from a licensed dealer.

What the law allows is the carrying of a concealed firearm without a license and without any training.

Green = No permit required to carry a concealed handgun.
Dark Blue = Permit to carry automatically granted, presuming one is not a prohibited person (felon, domestic abuser, etc.).

Maine, Vermont, New Hampshire, Virginia, Kentucky or Idaho?

According to the World Atlas those are the six states with the lowest crime rates. Five of them have Constitutional carry.

FYI- Connecticut, New Jersey, Rhode Island and Wyoming round out the top 10.

That have Constitutional carry, there will be little to no effect. There may be an initial bump up or down but a year or two out will be the same as before.

OTH it equally seems to not deter crime as proponents claim; the rate will likely have no change.

Of who bought what. However buying from a Federally licensed dealer requires a check against NICS. Any private party that knowing sells to a prohibited person is committing a felony punishable by up to 10 years.

According to the FBI UCR report, Texas shows that in 2019, there were 838 homicide incidents.

Of those, 324 involved Firearms and of those 272 involved handguns.

Aggravated assaults:

in 2019 there were 39,900 aggravated-assault incidents, of those 7334 involved handguns and 4102 involved firearms.

The real trick will be to remember about this thread and then compare these numbers to the 1st full year after the passage of this law to see if there is any substantive change in the #s.

I predict, however, that no one will bother to do this because it will disrupt their righteous diatribe.

and given that a handgun will remain functional for centuries with only minimal maintenance, I think it fair to say that handgun homicides will occurring in this country indefinitely.

60. That is not a realistic expectation

as firearms have a life cycle measured in decades and in some cases centuries.

Unless of course you are advocating the wholesale seizure of all firearms (which would run afoul of the 4th, 5th & 6th amendments) as a solution...

But staying on topic:

If this law is as much of a total disaster as mentioned by many up thread, there should be a huge spike in the number of firearm homicides in Texas. As I do not predict the future, I will wait for the actual numbers to come in and see if the fears are unfounded or not.

exactly, however, CA is 4.6 per 100k while TX is 5. Of course, numbers are only as accurate as who counts them. Bottom line, less guns equal less gun violence, AND death. and BTW, TX leads our country with rate of gun violence per capita.

62. They really wouldn't like MY suggestion

Some airplanes require a Type Rating to fly. All jet aircraft and any aircraft rated for 12,501 pounds or higher maximum takeoff weight requires one. The government wants to know before they let you fly around in a 737 that you can safely fly it, so you must take training and a flight test before you're allowed to fly the plane without an instructor in the cockpit with you.

So...why not type ratings for guns? Anyone who wants to carry a certain model of gun should be required to disassemble and reassemble the gun in front of a firearms instructor, and then fire a qualifying score with it on the Army's "Alternate Course C" target before they're allowed to carry the gun uncased. Once you get (say) a Glock 19 pistol type rating you can have all the Glock 19s you want, but if you want a Ruger Super Blackhawk pistol you have to add a Super Blackhawk rating to your card.

64. As a practical matter, there are *far* more models of guns than there are such aircraft, and

firearms take considerably less skill and training to use safely. I could learn to fieldstrip and operate a Steyr AUG in an afternoon; learning to fly a 787, even if one is already a pilot, is a rather more complex undertaking.

While I'm not in favor of such a regulation, I would suggest that it would make more sense for the type ratings to be for classes of firearms rather than specific models. Say, semiautomatic rifle, or single action revolver.
