228 GOP lawmakers call on Supreme Court to overturn Roe v. Wade

Under normal circumstances, the Supreme Court is reluctant to overturn past cases, relying upon a doctrine called "Stare Decisis" which is roughly translated to mean "stand by the thing decided." The doctrine reflects a respect for the accumulated opinions that have been handed down in history as well as the consistent development of legal principles.

"A history of confusion in the lower courts, an unstable pattern of Supreme Court decisions, and a persistent lack of judicially manageable standards all suggest that a precedent is or has become unworkable," they said in their friend of the court brief.
The Center for Reproductive Rights is representing the clinic and its medical director, Sacheen Carr-Ellis. Lawyers for the center will respond to Mississippi's appeal later this year.
Last year, the group urged the justices to allow the lower court opinion to stand, arguing that Supreme Court precedent makes clear that before viability "it is up to the pregnant person, and not the State, to make the ultimate decision whether to continue a pregnancy."

I just read an article posted by Reuters saying that, under the USSCs shadow docket process, the conservative majority on the USSC granted emergency requests by Christian and Jewish groups challenging COVID 19 restrictions imposed by officials in NY state. The article also found that the court favored TFGs administration while denying almost 100 applications by other private individuals or groups. TFG prevailed on 10 death row issues and on 9 issues brought by Republican officials in red states to curb efforts to facilitate voting during the pandemic. Meanwhile, not one of the private petitions or 33 pro-se petitions were granted.

MY NOTE: There is no transparency to the USSCs shadow docket process yet shadow docket decisions have just as great an impact on our lives as the courts published decisions. President Bidens commission to study USSC reform is said to be addressing this issue, however, Supreme Court lawyers are not supportive of changes to the shadow docket.

(24,632 posts)the 1964 Voting Rights Act, this present federalist society court will gut the 1973 Roe vs Wade law when they begin to nibble at the edges , and then they will go after Social Security and Medicare and nibble at the edges ...because dark money after all is free speech....just ask John Roberts...and his cronies...

Or they will send the mistress or daughter to someplace overseas and she will get the abortion there. This is to control the working class, ensure a supply of cheap labor - that is what SCOTUS and their also rich RW friends are driving towards and always has been. Of course in their ideal world the working class has no vote and they are also working hard for that too.
I remember in High school several girls with rich daddies who would SUDDENLY decide to do a semester of schooling abroad.
They all went to some school in one of the Scandinavian countries for six months.......

(16,691 posts)If Roe v. Wade is overturned, r politicians will lose one of their big talking points. I should say blathering points.
Whether or not the article is about politicians specifically asking the USSC to overturn an established ruling, or if it is about the stance of politicians on the national stage, if r's succeed in repealing this ruling, they might keep their old guard in hand, but newer or younger cons might not be attracted. Nor will the over 70% of American voters who think abortion should be legal.

Between losing this faction and the fossil fuel purchased faction, the republicans will lose a lot of support.
