Challenges to Madison Cawthorn can't proceed under new district, elections board says

The challenges argue that Cawthorn should be disqualified from running for office because of what they allege is his involvement in the Jan. 6, 2021, attack on the U.S. Capitol. Cawthorn denies being involved in the attack.
Cawthorn, a first-term Republican who was elected in 2020 from what was then North Carolinas 11th Congressional District, in the westernmost part of the state, filed in December to run for a second term from the newly drawn 13th district enacted by the Republican-controlled legislature in November.

In a letter to attorneys representing 13 North Carolina voters who filed complaints challenging Cawthorns eligibility to run for reelection in January and February, Katelyn Love, general counsel for the State Board of Elections, said that since none of the challengers currently reside in the new 13th district, they are no longer qualified under state law to challenge Cawthorns candidacy.

If the BOE won't do their job, then that is something his Democratic opponent will have to talk about.
Supporting an insurrection is serious stuff. He needs to be held accountable.

(6,035 posts)The Republicans are very good at stall tactics, so it takes years to get what should take months.
In this case, time is of the essence. There needs to be action sooner than later.
If we can't block this guy now, he'll be reelected and then it will take a conviction to get him out of Congress. With appeals, and possibly a change of leadership in the White House, it might not ever happen.
Window closing this year.

He's going to remain as a constant presence, because we're unwilling to neuter him.

(7,830 posts)prior to the previous redistricting which is now overturned. The state had redistricted previously and named the area as the 13th district. Cawthorn then filed to run in the 13th. When the latest map was released that area was once more labeled as the 11th , while the 13th was now an area in the middle of NC.
As it stands I suppose Cawthorn may refile to run in 11th at which point I suspect the suit would need to be refiled as well. The sequence of process past that point is unclear as to how quickly the determination would be made and when the board would act.
The whole thing may become moot if Cawthorn is found to be part of the Jan 6th gang and is punished accordingly, but that will likely not happen prior to the election. The conservative voters of the 11th district would chose anyone of similar political outlook. Cawthorn is from the same district that elected Mark Meadows repeatedly.
It is not clear how much effect publicity over this and over Jan 6th have affected Cawthorn's popularity in the 11th district. It seems unlikely he would face a primary opponent from his own party at this late date.
However, this is North Carolina and stranger political things have happened before.
