Indiana attorney general sues hospital system over privacy of Ohio girl who traveled for abortion

INDIANAPOLIS — Indiana’s attorney general has sued the state’s largest hospital system, claiming it violated patient privacy laws when a doctor publicly shared the story of an Ohio girl who traveled to Indiana for an abortion.

The lawsuit, filed Friday in Indianapolis federal court, marked Attorney General Todd Rokita’s latest attempt to seek disciplinary legal action against Dr. Caitlin Bernard. The doctor’s account of a 10-year-old rape victim traveling to Indiana to receive abortion drugs became a flashpoint in the abortion debate days after the U.S. Supreme Court overturned Roe v. Wade last summer.

Rokita, a Republican, is stridently anti-abortion and Indiana was the first state to approve abortion restrictions after the court’s decision. The near-total abortion ban recently took effect after legal battles. “Neither the 10-year-old nor her mother gave the doctor authorization to speak to the media about their case,” the lawsuit stated. “Rather than protecting the patient, the hospital chose to protect the doctor, and itself.”

The lawsuit named Indiana University Health and IU Healthcare Associates. It alleged the hospital system violated HIPPA, the federal Health Insurance Portability and Accountability Act, and a state law for not protecting the patient’s information.

this lawsuit sure as hell will destroy her right to privacy.

3. Doctors linign up to protect

Their own. Sounds lfike cop unions.
They need to ban this doctor from practicing.
THe hospital needs to be fined millions adn the directors removed from any medical job.

6. You're misunderstanding the situation. The girl's privacy was not breached.

The anti-abortion supporters are just trying to get even with the doctor for explaining how she had to send a 10 year old girl (name withheld) out of state because of Indiana's draconian total abortion ban.

The doctor is the "good guy" here. The AG is trying to make sure that he gets his misogynistic way and prevents any abortions from taking place anywhere.

Indiana's laws changed after her case.

But the doctor is still the "good guy," and Rokita is putrid human being.

Medical care givers, without naming the patient, exposing the extreme cruelty and flipping insanity of legislators making medical decisions by way of limiting medical options.

8. The doctor didn't breach anyone's confidentiality.

She mentioned a case. She didn't name the patient.

So far, I haven't heard that the girl's family is upset about what the doctor has done.

17. That's not how HIPAA works

Did a quick review of the doctor's comments and I saw no PHI violations.

Also I'm not understanding what the state interests is in a potential release of a person's private information?

My understanding is the parents support the doctor so what exactly is the state's standing to bring the case?

18. How much time and taxpayer money will this AG spend trying to criminalize a doctor who helped
