(17,066 posts)As long as the Trump faction maintains the lawfulness of the order, then they can claim Yates overreached by failing to support a lawful action. And we have already been told by Mitch McConnell that the lawfulness of the order will be "determined by the Courts." Which, of course, the Trump faction intend to stack to their advantage, starting with the USSC. Thus the need for the Senate to block any conservative USSC nominee becomes even more important.
Keep in mind that the stays of execution of the XO have been temporary, pending determination of whether the XO is lawful or not. If corrupt courts rule the order lawful, then lawful it is. There is no further recourse.
