VT's Election Chief Asks SCOTUS To Correct Error In Kavanaugh Opinion

Vermont Secretary of State Jim Condos (D) formally requested, via a letter to the clerk of the Supreme Court, that a Justice Brett Kavanaugh opinion that mischaracterized the state’s plans for the election be corrected.

In his concurrence explaining why he was voting in favor of a requirement that Wisconsin absentee ballots be received by Election Day, Kavanuagh argued that courts should defer to state legislatures when it came to adjusting election rules for the pandemic.

Kavanaugh pointed specifically to Vermont as a state that has “decided not to make changes to their ordinary election rules, including to the election-day deadline for receipt of absentee ballots.”

That assertion was wrong, as Condos’ letter Wednesday pointed out. Vermont made two major changes, because of the pandemic, to how it was handling the election. Its legislature approved the proactive sending of mail ballots to all active registered voters. And Condos additionally okayed a policy that will allow local election officials to begin processing absentee ballots 30 days before the election.

“These two actions factored significantly in our decision to hold to existing law requiring the election day receipt of mailed ballots rather than extending returns beyond election day based on postmark,” Condos said.

Beyond just noting the factual error, Condos’ letter argued that the election changes that Vermont embraced made it a poor comparison point for Wisconsin, where the legislature has pointedly refused to let the processing of absentee ballots begin earlier or pass other laws that would help absentee voters get their ballots in sooner.

• Yesterday, Vice President Biden visited Warm Springs, Georgia and delivered remarks focused on unity and healing with one week left before the general election. He later spoke at a second rally in Atlanta, where he urged Georgians to vote for Democrats up and down the ticket. You can watch his full remarks in Warm Springs and Atlanta.

• Joe Biden will receive a briefing from public health experts. After, Vice President Biden will deliver remarks on his plans to beat COVID-19, lower health care costs, and protect Americans with pre-existing conditions. You can watch HERE.

• Kamala Harris will travel to Phoenix and Tucson, Arizona to urge Arizonans to make a plan to vote early. In the morning, Senator Harris will meet with a group of Latina business owners in Tucson. After, Senator Harris will participate in an early vote mobilization event. In the afternoon, Senator Harris will travel to Phoenix to meet with a group of Black leaders. Later, Senator Harris will participate in an early vote mobilization event with Grammy Award-winning singer and philanthropist Alicia Keys.

• Doug Emhoff will travel to Lehigh and Centre Counties where he will rally volunteers and encourage Pennsylvanians to make their voices heard by casting their ballots for the Biden-Harris ticket. First, he will kick off a canvass at Biden for President Pennsylvania’s Voter Activation Center in Allentown. Later, he will visit State College, where he will encourage students and community members to make a plan to vote in this election.

• Joe Biden and Kamala Harris released a statement on the shooting of Walter Wallace Jr. In his statement he stated that “Walter Wallace’s life, like too many others’, was a Black life that mattered — to his mother, to his family, to his community, to all of us.”

Jack Burkman and Jacob Wohl Indicted AGAIN Over Voter Intimidation

Conservative operatives Jacob Wohl and Jack Burkman have been indicted in Ohio, once more over a racist robocall aimed at minority voters.

Wohl and Burkman, who rose to some level of infamy online for blundering attempts to manufacture sexual assaults allegations against Democratic politicians and other Trump foes, have each been charged in Ohio’s Cuyahoga County with eight counts of telecommunications fraud and seven counts of bribery, a charge that includes attempts to convince people not to cast ballots. The indictment only adds to the growing mountain of criminal and civil problems facing the notorious pro-Trump pair.

In late August, a robocall that claimed to come from Wohl and Burkman warned voters not to use mail-in ballots, falsely claiming that the ballot information would be used to enforce vaccine mandates and collect on credit card debts. In the call, which was sent to 67,000 voters in the Midwest, according to prosecutors, a Black woman warned potential voters not to send in mail-in ballots or risk being fooled by “the man.”

“The right to vote is the most fundamental component of our nation’s democracy,” Cuyahoga County Prosecutor Michael C. O’Malley said in a statement. “These individuals clearly infringed upon that right in a blatant attempt to suppress votes and undermine the integrity of this election These actions will not be tolerated.”

• Yesterday, Joe Biden traveled to Chester, Pennsylvania where he blasted the Trump administration's response to COVID-19 following Chief of Staff Mark Meadows’ admission that they’ve given up on getting the virus under control.

• Today, Joe Biden will travel to Georgia. In the afternoon, Vice President Biden will deliver remarks in Warm Springs on bringing Americans together to address the crises facing our nation. Vice President Biden will say that Americans have always come together to triumph and overcome, and that we can, must, and will again now. After, Vice President Biden will attend a drive-in event in Atlanta to encourage Georgians to make a plan to vote during the last week of early voting in the Peach State. • Kamala Harris will travel to Reno and Las Vegas, Nevada for voter mobilization events to urge Nevadans to make plans to vote early through October 30. In the afternoon, Senator Harris will participate in an early vote mobilization event in Reno. In the evening, Senator Harris will travel to Las Vegas to participate in an early vote mobilization event.

• Jill Biden will travel to Bangor, Maine to headline a socially distanced Get Out the Vote rally. Participants at the event will include Governor Janet Mills, House Speaker Sara Gideon, and Hermon High School teacher Jesse Hargrove.

• Yesterday, in an op-ed for CNN, Senators Tom Udall and Elizabeth Warren outlined the dire consequences for Indian Country if Donald Trump and Senate Republicans are successful in nominating Amy Coney Barrett to the Supreme Court. With millions of ballots cast, and Native communities disproportionately impacted by the COVID-19 pandemic, the senators argue that placing Barrett on the court could lead to the destruction of the Affordable Care Act, and with it, the health care of many in Indian Country.
