Texas sues the Biden administration over federal COVID-19 vaccine mandates

Attorney General Ken Paxton, on behalf of the state, sued the Biden administration on Friday over its coronavirus vaccine mandate for federal contractors.

The federal requirement, which is set to take effect Dec. 8, calls on all federal workers and contractors to be vaccinated against COVID-19. The Texas lawsuit comes after similar suits filed by Florida and Georgia, along with several other states.

“The Biden Administration has repeatedly expressed its disdain for Americans who choose not to get a vaccine, and it has committed repeated and abusive federal overreach to force upon Americans something they do not want,” Paxton said in a statement. “The federal government does not have the ability to strip individuals of their choice to get a vaccine or not. If the President thinks his patience is wearing thin, he is clearly underestimating the lack of patience from Texans whose rights he is infringing.”

Paxton and fellow Republican Gov. Greg Abbott have been at war with local and federal officials over vaccinate mandates. Earlier this month, Abbott expanded an executive order to block the requirement for any entity in Texas, including health care facilities and private businesses. He previously banned cities, counties, school districts and state agencies from requiring vaccines. Lt. Gov. Dan Patrick has tweeted that vaccination “should never be forced on anyone by the state or a private employer.”

Being vaccinated offers better protection than being infected: CDC study

Natural immunity due to having COVID is not as good as the vaccine

A new study from the CDC finds that people with "natural" immunity through infection were more than five times more likely to become infected with COVID-19 compared to people who were fully vaccinated.

The study reviewed more than 7,000 people across nine states, measuring infections and hospitalization rates three to six months after either vaccination or initial infection. The study -- published in the CDC's weekly journal, the MMWR -- reaffirms prior research indicating that vaccines offer superior protection than natural immunity.

Trump's Truth App Gets Demand To Stop Violating Software License

Former President Donald Trump’s new TRUTH social network is in violation of the software license it’s built on and must get in compliance, the holder of the license demanded this week.

The company that holds the software license for the open source code sent TRUTH Social, the Trump-founded venture, a letter demanding compliance with its software license, Mastodon CEO Eugen Rochko said in a statement.

Rochko told TPM last week that he believed an early version of Trump’s network was using open-source software that he developed, called Mastodon, without abiding by the terms of the license that make it available to use.

Rochko said in the statement that though he would “prefer if people so antithetical to our values did not use and benefit from our labour,” the reality of open-source, free software means that “you give up the possibility of choosing who can and cannot use it from the get-go.

In Virginia, USPS agrees to prioritize election mail

Lawsuit filed on behalf of the Democratic Party of Virginia against the U.S. Postal Service over its failure to process and deliver election-related mail in a timely manner, potentially leading to the disenfranchisement of Virginians seeking to cast absentee ballots for the statewide election on Nov. 2. The complaint argues that the Postal Service’s failure to delivery absentee ballot applications and ballots in a timely manner will significantly burden and potentially disenfranchise thousands of Virginia voters in violation of the First and 14th Amendments. The lawsuit asks the court to order the Postal Service to prioritize and expedite the processing of election-related mail and to immediately process any unscanned election materials in Albemarle, Portsmouth and James City Counties, where delays are of particular concern. The plaintiffs filed a motion for a temporary restraining order and preliminary injunction in line with these requests, after which the parties agreed to certain terms to ensure the timely delivery of election mail. Specifically, the Postal Service will: 1) ensure that completed absentee ballots being returned to county elections officials are properly postmarked and scanned; 2) expedite the delivery of completed absentee ballots; and 3) conduct an “All Clear Certification Process” daily through next Friday. Nov. 5 where employees sweep all locations and certify that facilities are “clear of all Election Mail committed for delivery that day.” The Postal Service will provide daily reports to the DPVA about the “All Clear” process from the previous day, as well as estimates of travel times for completed absentee ballots.
