Clinton IT Staffer Still Refuses to Testify Before Congress

A lawyer for Bryan Pagliano, the former State Department computer staffer who set up Hillary Clinton’s private email server, recently informed Congress that he will not testify before Senate committees investigating Clinton’s email setup.

The Associated Press obtained a letter sent by Mark MacDougall, Pagliano’s lawyer, on March 11 indicating that his client would “respectfully decline” the offers from the Senate Judiciary Committee and the Senate Homeland Security Committee to testify before congressional lawmakers.

Pagliano declined to testify before the committees even after he was granted immunity by the Justice Department and has been cooperating with the FBI in its investigation into Clinton’s email setup.

The former State Department IT staffer asserted his Fifth Amendment right in September in response to a subpoena from the House Select Committee on Benghazi to testify before congressional lawmakers. The Senate Judiciary and Homeland Security Committees had also reached out to Pagliano then to testify.

If Bernie Sanders Isn’t Democratic Nominee, Don’t Blame Bernie or Bust for Trump’s Victory

Why would Bernie or Bust voters risk a future with Donald Trump by refusing to vote for Hillary Clinton?

It’s structural change Bernie or Bust wants; it’s the status quo that Clinton voters want to uphold. I state the case for writing-in Bernie Sanders, if he isn’t the Democratic nominee, in this YouTube segment.

As we’ve heard throughout this election, “Don’t let perfection be the enemy of the good.”

Sure, Clinton would be better than Trump, but better won’t prevent the next endless war, or devastating financial collapse. President Obama is sending even more American soldiers to Syria, imagine what Clinton would do as president.

Lawyers for a reporter demanding access to email messages and files the FBI has reportedly retrieved from Hillary Clinton's private server are objecting to a secret filing the Justice Department submitted to a federal court last month as part of a bid to keep those messages under wraps.

That is unique - it means the reasoning for denying the request is detrimental, not just the content.

The FOIA request was in regards to the ‘personal’ emails that Clinton deleted but were eventually recovered by the FBI. Clinton described those emails as wedding plans, yoga routines, and emails to Bill Clinton.

The DOJ now has until April 26th to explain why they couldn’t reveal the reasoning behind denying the FOIA request and why they did this in secret. If her ‘personal’ emails that she deleted contained classified content that would put her in a very precarious position. The Clinton’s have had to maintain that no classified material was located in her personal emails as legally they were all supposed to be the property of the State Department — and it is a crime to destroy classified material.

Just how serious is the FBI investigation into Hillary Clinton’s emails? Since the bureau doesn’t like to speak about it publicly, people have to judge from outside signs—for example, how many agents are working on the case. So when The Washington Post reported this week than there were 147 FBI investigators looking into whether any crimes were committed in the handling of classified material on Clinton’s private email server, and whether that server was hacked, it was a bombshell. Republicans exulted and Democrats felt a rising nausea. The story swept across cable TV and the web.

Except it turns out maybe that wasn’t the case. The FBI now says there are fewer than 50 agents working the case, though it won’t say how many, and the Post corrected its article. It’s yet another case of confusion and fog of war in a story that involves a scandal-plagued political dynasty, partisan intrigue, the intelligence community, the FBI, the vagaries of federal email rules and national-security law, and the obscure world of cybersecurity. Something went wrong here—Clinton has apologized for using the server—but whether any crime was committed remains hazy, subject to interpretations filtered through a partisan lens and leaks from an investigation that remains largely under wraps.


The Post report did lay out in clear sequence how the controversy began. As soon as she became secretary of state, Clinton was frustrated by rules that prohibited her use of her personal Blackberry while in her office in Foggy Bottom. She and her aides considered several possibilities for getting her email access, including asking the NSA to provide a specially encrypted device to her, similar to the one President Obama had received. (That request was turned down.) Clinton never got an encrypted Blackberry, but she began using her private email server in early 2009.

At the end of February, the State Department released the last batch of Clinton’s emails, as ordered by a federal judge. Earlier this month, The Washington Post reported that the Justice Department has granted immunity to a former Clinton staffer to work with investigators, an indication of progress in the criminal case over the emails. Bryan Pagliano, the staffer, helped Clinton set up a server in her home in New York, which she used for her emails while running the State Department. Pagliano previously invoked his Fifth Amendment right against self-incrimination when called to testify by congressional committees. A spokesman said the Clinton campaign was “pleased” that Pagliano was cooperating, though what else are they going to say?

Debbie Wasserman Schultz has said the idea that Hillary Clinton could face any legal troubles over her private email server is “ludicrous.”

“How do you know that?” Chris Wallace asked the DNC chairwoman in a Fox News Sunday exclusive.

“I’m simply confident that – as the investigation continues, that Hillary Clinton has made it clear, and there are scores of individuals who ae associated with the federal government that have indicated that – it’s clear that she conducted herself completely legally,” said Wasserman Schultz.

“I think that at the end of the day, this is going to amount to nothing more than an investigation. When they take a close look, I think she’s going to be fine.”

Judge: AZ presidential preference vote can be challenged

PHOENIX — A judge on Monday ruled it’s legal to challenge last month’s presidential preference election.

Maricopa County Superior Court Judge David Gass said it remains to be seen whether the Tucson man, John Brakey, contesting the election — and seeking to void the results — can prove his case that the things that went wrong merit voiding the vote.

During the first day of hearings Monday, Assistant Attorney General James Driscoll Maceachron, defending Secretary of State Michele Reagan, told the judge that Arizona law allows someone to contest the outcome of a political primaries between candidates. Ditto, he said, if the issue is something like an initiative or bond election.

But he said there is no authority to challenge the state’s presidential preference election, which is neither a primary in the traditional sense nor a ballot measure.

New DNA technology helped clear man in 1989 rape

LAKE COUNTY, Ind. -- A northwest Indiana man who served nearly 25 years in prison was released on Monday after new DNA technology cleared him in a 1989 rape.

Darryl Pinkins, 63, walked out of a Lake County correctional facility shortly before 11 a.m. "48 Hours'" cameras captured Pinkins' emotional reunion with his family, including a 24-year-old son who wasn't yet born when he began his prison term. Producers have followed his story two years.

Pinkins was convicted in 1991 of raping a Hammond woman. He's always maintained he was at home in bed with his wife when the attack happened.

Since 2007, teams from the Indiana and Idaho Innocence Projects and the Indiana University Law School wrongful conviction clinic have been working to prove his innocence. The case marks the first exoneration using a new DNA analysis program called TrueAllele, according to an Innocence Project news release. The process can provide reanalysis of old DNA results to pinpoint which people contributed to DNA mixtures.

I would like to propose a new National Party rule:


I would like to propose a new National Party rule:

No delegate shall be seated who is part of the actual elections apparatus. Meaning, no one who is involved officially on any polling place or in any elections room shall be allowed to be pledged delegate at least. I have a name for the rule, but I don't want to be disruptive. I am serious about this. Let's avoid some of these coast to coast unseemly events next time, please. We are embarrassing good party members with bad behavior.
