Gov. Rick Snyder compares flooding of a Lake House to S.E. MI Residents Impacted by Tuesday Storms

Here we go AGAIN.....

"As exclusively reported on IUNT December 30, 2013 or four days after Christmas, Michigan Governor Rick Snyder was tardy in response to Mid-Michigan residents last Winter experiencing severe power outages during an massive ice storm.

It would appear Gov. Snyder, vying for re-election on November 4, has yet to change an overall dismissive response to Michigan residents in midst of temporary crisis.

This time the residents are in S.E. Michigan. Detroit, Warren, Michigan and other surrounding communities adjacent to the heavily traveled expressways of I-75 and I-696 continue to dig out from massive rain storms flooding streets, basements and businesses."

Michigan Voters Lack of Information on Proposal 1 of 2014, Leads Pending Language Clarity Lawsuit...

Do we, the public-at-large vote on issues without having all the complete information to do so? Is our main steam media complicit in holding back facts we need to know at times of importance? Does the low voting turnout during Michigan's August 5, 2014 primary means a similar low voter participation rate for November 4, 2014 General Election?

Part 1 -The answer to all of the above questions is yes:

"Michigan's Supreme Court on July 14 majority opinion decision on International Business Machines (IBM) Corporation v Department Of Treasury, case docket 14644, will have large implications for the state budget going forward.

As it stands right now, the state of Michigan is on the hook to IBM and likely 147 other corporations filing legal briefs in this case, for upward to $1.1 Billion dollars or more.

Writing for the majority, Justice David Viviano stated:

"It is a well-established rule that in the construction of a particular statute, or in the interpretation of its provisions, all statutes relating to the same subject, or having the same general purpose, should be read in connection with it, as together constituting one law, although they were enacted at different times, and contain no reference to one another.

The endeavor should be made, by tracing the history of legislation on the subject, to ascertain the by tracing the history of legislation on the subject, to ascertain the uniform and consistent purpose of the legislature or to discover how the policy of the legislature with reference to the or subject-matter has been changed or modified from time to time.

In other words, in determining the meaning of a particular statute, resort may be had to the established policy of the legislature as disclosed by a general course of legislation. With this purpose in view therefore it is proper to consider, not only acts passed at the same session of the legislature, but also acts passed at prior and subsequent sessions," Id. at 543-544 quoted."

Simply put, before a legislative body enacts a law, the Representatives are expected to perform due diligence. Ensuring outstanding questions related prior statutes similar in nature, are addressed in the new legislation.

At play in the Michigan Supreme Court July 14 decision is Michigan Business Tax (MBT) from 2007, the Multistate Compact Tax Statute from 1969, and a Business Tax cut for C & S Corporations in HB 4361 of 2011.

Michigan Multistate Tax Compact of 1969 purpose was to “proper determination of state and local tax liability of multistate taxpayers, including the equitable apportionment of tax bases and settlement of apportionment disputes.” In this case businesses operating in Michigan, whose headquarters or primary physical location is not located in state, would be subject to state and local taxation rates on revenue made, in Michigan."

Ruling in corporate tax case could cost Michigan $1 billion

In a strongly worded post-opinion motion seeking a rehearing of the case, Attorney General Bill Schuette said the ruling “results in the state potentially owing a budget-busting aggregated tax refund in the hundreds of millions of dollars (not including interest) to mostly out of state corporations.

“The total cost to the state is likely to exceed $1 billion,” Schuette said.

In a separate motion asking the court to stay its July 14 ruling “as to all lower court cases,” Schuette said there are 134 similar cases filed by out-of-state corporations pending in Michigan courts and “there are thousands of potential claims.”

"Kurt Weiss, a spokesman for the Michigan Department of Technology, Management and Budget, said officials believe most of the impact would be felt in the 2014-15 fiscal year, though there could also be some impact this year.

“It creates a significant problem for the budget,” Weiss said. “We are hoping for reconsideration from the Supreme Court.”

It’s exceedingly rare for the Michigan Supreme Court to reverse one of its own opinions in a rehearing.

And an appeal to the federal courts does not appear to be an option, said Dave Murray, a spokesman for Gov. Rick Snyder.

Justice David Viviano wrote the majority opinion in favor of IBM, joined by Justices Michael Cavanagh and Stephen Markman, and by Justice Brian Zahra, who wrote a separate concurring opinion. Justice Bridget McCormack wrote the dissent, siding with the Treasury Department, joined by Chief Justice Robert Young Jr. and Justice Mary Beth Kelly.

At the heart of the cases are state corporate income tax policies designed to favor local corporations at the expense of out-of-state corporations, Hamilton said. The Michigan Business Tax, which was repealed in 2011, required out-of-state corporations to calculate their taxes based on sales, she said."

But since 1970, Michigan has belonged to a multistate compact, intended to make things easier for out-of-state corporations by providing greater uniformity in how they calculate their tax bills for various states. Under the compact, corporations have the option of using the state tax law or an optional formula that considers not just sales but the property and payroll a corporation has in a given state.

Weighing in those factors generally leads to lower income tax bills for out-of-state corporations, Hamilton said. And companies such as IBM went to court to argue they could still use that method, despite what the MBT said.

The Michigan Court of Claims sided with the Michigan Treasury Department, as did the Michigan Court of Appeals.

But the Michigan Supreme Court has ruled for IBM, rejecting the state’s arguments that Michigan implicitly repealed the alternative tax calculating option set out in the compact when it passed the MBT — even if it didn’t explicitly do so.

The Legislature “had full knowledge of the compact and its provisions” when it passed the MBT, yet it “left the compact’s election provision intact.”

In fact, the court suggested the Legislature shot itself in the foot in 2011, when it amended the legislation related to the multistate compact to say that starting Jan. 1, 2011, out-of-state corporations no longer had the option of using the three-pronged method to calculate state taxes.

If the Legislature hadn’t wanted corporations to use that method in 2008, 2009 or 2010, it would have made the 2011 statute fully retroactive, the court said.


And some Michiganders were FOOLED into voting for Proposal 1 of 2014, cutting the Business Tax on Equipment just on Tuesday. What a joke on them, this is.

State of emergency declared in Lucas County after toxins found in Toledo water

"A state of emergency was declared today in Lucas County and the greater Toledo area after tests at the Collins Park water-treatment plant in East Toledo produced two toxin sample readings.

Chemists testing water at Collins Park plant found two sample readings for microcystin -- a toxin that is released by algae blooms -- that exceeded the recommended “do not drink” standard of one microgram per liter standard. About 400,000 people in and around Ohio‘s fourth-largest city are affected.?

Within hours after the warning was issued, Ohio Gov. John Kasich declared a state of emergency for Toledo and the surrounding areas affected, including Fulton County. Early today, residents descended on stores, quickly clearing shelves of bottled water.

Toledo Mayor D. Michael Collins and health leaders asked residents to remain calm and said they may have answers later today on when Toledo-area water supply will be safe to drink again. Water samples were sent to Michigan and Cincinnati for testing; a third sample is headed to Columbus at about 3:30 today. Mayor D. Michael Collins said each test is different and will allow a “triangulation” of tests. The mayor declined to say when test results might be available. He did not want to “put a burden of time” on results."

Don't know about you however, this is a bit concerning indeed. Let's see. Detroit - Water Shut Off Crisis, California -- Water Drought and limiting of Water Resources for reservation purposes, Toledo, Ohio -- No One Can Drink the Water, Period.

Ran into a lady from Toledo, Ohio this morning on the way to a weekly political forum at Speedway.

The nice lady, "I hope he (the cashier) won't think I'm crazy having to buy 10 cases of bottled water.

Reply, "What's wrong? Are you living in Detroit?"

Nice Lady, "No, I'm from Toledo. They just declared a water emergency and we can't drink or boil our water."

Reply, "What the hell?".

Nice Lady, "In fact, they are saying the water is contaminated from Lake Erie."

Reply, but thought in head first (Oh, Shit --- Lake Erie -- Hello our water in S.E. Michigan could be at risk for contamination too), "Wow....just wow. We have not heard a peep about this on local news. Will tell others. Thanks and hope you'll will be okay."

Ummm...is anyone else concerned? Just wondering.

Michigan's Proposal 1 of 2014, is another Tax Shift disguised as Fathom Jobs....

"To say that Michigan's Proposal 1 coming to an PRIMARY election ballot near you August 5, 2014 is a hot pile of stinking mess, is a understatement. Commercials are marketing pitches, whose core design is to make the business, product, person or entity appear to be the best option to take.

Remember this statement when as a Michigan resident, you view the commercials sponsored by the States' Chamber of Commerce regarding how Proposal 1 of 2014 will magically create 15,000 jobs on its' own.

Why is Michigan's Proposal 1 of 2014 is a hot pile of stinking mess?

Problem One:

Well, a number of reasons but first and foremost, the appointed board who would decide where Usage Tax Funds are allocated. The Usage Tax in Michigan would increase on services such as renting a car, staying in a hotel room, receiving a haircut from a barber or hairdresser or buying equipment on Amazon.com.

Wait, buying equipment off of Amazon.com? Yes, that too as the State would ensure Amazon or any other e-commerce operated business charge the Michigan Sales Tax (6.0%), plus a new Usage Tax Fee on equipment purchases made over the internet.

Back to the "Appointed Board" determining where revenue received by Proposal 1 of 2014 Usage Tax is allocated to municipalities throughout the state. Normally, state governmental units quasi "Appointed Boards" are made up of political operatives who someone owe a favor, or the appointees themselves owe many favors to the Appointing Official(s).

For Proposal 1 of 2014 behalf, if passed into law, the board members would be Appointed by the Governor in office at the time. Yet, another reason this Proposal is a deep, long pile of stinking hot mess, while taking a moment to reflect on the last three years of Republican controlled and operated State Government in Michigan.

Problem Two:

Michigan's Proposal 1 of 2014 tall tales claims of tax savings for alleged "small businesses" the propaganda filled commercials boasting loudly about on a TV screen near you, are not the only businesses who will be the benefactors' of this "tax break".

Say hello to large businesses, yet again, getting another tax break at our expense."

Protest was organized by National Nurses United, Robin Hood Tax USA with the support of the National Writers Union.

Detroit's Bankruptcy, An Unique Opportunity To Transfer Wealth Assets-The March 2013 Interview

"Looking back on the nearly 18 month period since the City of Detroit entered the roads leading to U.S. Bankruptcy Judge Steven Rhodes Court, we reflect on the variety of twists and turns traveled.

From the Fiscal Crisis first declared by Michigan Governor Rick Snyder (R) in early 2013 and then former State Treasurer Andy Dillon, to a forced Consent Agreement for a period of nine months, ultimately leading to the appointment of former Jones Day Bankruptcy Attorney from way of Maryland, Kevyn Orr's rein as Detroit's Emergency Manager."

Minutes after 5:00 pm on July 11, 2014, several local media resources revealed an unnamed source affirmed Detroit Retirees voted for what is known as the Grand Bargain -- an legislative deal designed to cut earned pensions 4.5% or more, along with health and life insurance. Up to 20,000 retirees will be impacted by the true results of this vote. This is despite language in Michigan's Constitution and Funding Document declaring promised pension benefits SHALL NOT be impaired.

U.S. Federal Bankruptcy Judge Rhodes is scheduled to make a finalized decision on Detroit's Bankruptcy July 18, 2014.

Over in Illinois during the first week of July, the State's Highest Court - Supreme Court of Illinois stuck down an 2012 Public Act which sought to cut health care benefits earned to retirees. Citing language in Illinois State Constitution in Article 13, Section 5 Illinois Supreme Court in a 6 to 1 majority barred State Legislative leaders or other resources of impairing retirees pension and health benefits - irregardless to whatever "fiscal crisis" of the moment is boasted.

However, Detroit's road to Bankruptcy Court sets it apart from any other State in the latest rounds of Austerity Focused legislative officials displaying a strong willingness to cut pension and benefits to retirees, before ever deceasing their own. Today, the focus is Water, plus in particular Detroit and by extension Michigan's natural resource of abundance, called The Great Lakes."
