NEW YORK (TheStreet) -- Our Moody's Analytics election model now predicts a Democratic electoral landslide in the 2016 presidential vote. A small change in the forecast data in August has swung the outcome from the statistical tie predicted in July, to a razor-edge ballot outcome that nevertheless gives the incumbent party 326 electoral votes to the Republican challenger's 212.
*The primary factor driving the results further to the incumbent party in August is lower gasoline prices. Plummeting prices and changing dynamics in global energy markets from Chinese weakness and the Iranian nuclear deal have caused us to significantly lower our gasoline price forecast for the next several years. This variable is very significant to voter sentiment in the model, with lower prices favoring incumbents.
It is important to note that the model does not reflect results if an election were held today, but relies on Moody's Analytics economic forecasts to determine what the world will look like in November 2016. Should gasoline prices rebound above the current baseline forecast by election time, the results of the model will move more in favor of the challenging Republicans. The forecast for house prices also accelerated moderately.
*The Moody's Analytics Presidential Election model forecasts whether or not the incumbent party will maintain control over the White House using a mixture of economic, demographic and political data. The model successfully predicts every election back to 1980, including a perfect electoral vote prediction in the 2012 election. "

Former N.J. mayor gets 25 years in prison for repeatedly raping relative's child
A former disgraced mayor of Marlboro was sentenced on Friday to 25 years in a Delaware prison for raping a child. He was the Republican mayor of Marlboro, N.J., from 1992 to 2003.
The attacks occurred when the girl was 6 years old, starting in 2006 shortly after Scannapieco moved to Delaware and following his guilty plea to charges of tax evasion and accepting $245,000 in bribes in New Jersey.
The assaults continued until 2008 when he was sentenced to 21 months in prison on those federal corruption charges.
*Scannapieco pleaded guilty last month to rape, unlawful sexual contact and continuous sex abuse of a child," van Amerongen said.
He said Davis cited Scannapieco's lack of remorse, his need for treatment and the age and vulnerability of the victim as some of the reasons for the heavy sentence.
The only factor the judge found in Scannapieco's favor, van Amerongen said, was his willingness to plead guilty, which allowed the victim, who is now 16, to avoid testifying at a trial.

Black Man Brutalized by Security Guard at Whole Foods for Trying to Buy Food
A black man was beaten to a bloody pulp by a security guard at an Oakland Whole Foods Thursday night after an attempt to purchase groceries led to an argument.
An eye witness to the attack, Zoe Marks, on visit from Edinburgh, Scotland where she lectures at the University of Edinburgh, gave an eyewitness account of the assault on her Facebook, posting graphic images of the victim. She told the Oakland Tribune that she saw the argument between the cashier and the victim as he was trying to use an EBT card (a food stamp card that works like a debit card), but said that the victim wasn’t “shouting,” nor was her “violent or disruptive.” In fact, Marks said the man wasn’t a threat to anyone and that she felt “safe” until the armed security guard came and “attacked him.”
In a Facebook status Marks described the “violent assault,” saying the guard “slammed” the victim against “concrete pillars.” He also allegedly put the man in a chokehold and “suffocated” him before throwing him on the ground unconscious. Then the guard reportedly locked the man out of the store despite the fact that he was unconscious.
She said none of the employees called the paramedics, instead they called for backup.

Plan targets health care bias against transgender people
Mirroring a shift in society, the Obama administration proposed Thursday to ban discrimination against transgender people throughout the health care system.
Once the proposed regulations are final, they should expand insurance coverage for gender transition and prohibit health care facilities from denying transgender people access to restrooms that match their individual gender identity.
The new protections are part of a broader rule from the Department of Health and Human Services to carry out anti-bias provisions of President Barack Obama's health care law. In a first, the law specified that sex discrimination is prohibited in health care, and the regulation carries it a step further, clarifying that "gender identity" is included under that protective umbrella.
"This is a huge step," said Michael Silverman, director of the Transgender Legal Defense and Education Fund in New York. "It covers a lot of ground."
* Jocelyn Samuels, head of the HHS Office for Civil Rights, said the rule does not explicitly require insurers to cover gender transition treatment, including surgery. But insurers could face questions if they deny medically necessary services related to gender transition by a man who identifies as a woman, or a woman who identifies as a man.
"It is basically a requirement that insurers use nondiscriminatory criteria," Samuels told reporters.
The new requirements would have impact throughout the health care system because service providers who accept federal dollars would have to comply."

Kim Davis Reveals GOP Support For Sharia Law
For almost seven years now, Republicans and conservatives have accused President Obama and Congressional Democrats of supporting “Sharia Law,” the concept within some quarters of Islam that believes religious law always trumps written law. There’s never been any evidence that Obama or Democrats support this and in fact, they have often supported laws they might not agree with in totality over personal beliefs.
In the case of Kim Davis, the Kentucky clerk who refuses to do her job in violation of the Constitution, state law and the U.S. Supreme Court, the veil has slipped once again from the right and we see that if anyone supports some sort of Sharia law in America, it is the Republican Party.
The case here is very cut and dry. The Supreme Court ruled that same-sex marriage in America is constitutional and legal in all 50 states and the District of Columbia. There can be no ban on those unions between legal adults in any state or jurisdiction in the country. You cannot restrict it, at all.
Yet several Republicans running for president, the job entrusted to defend that same Constitution, are backing Kim Davis. And doing so under the most absurd of justifications.
*America exists under a system of laws, not religious edict. Those laws protect the right to worship, but the beliefs of worshippers don’t have precedence over our laws. Several members of the Republican Party’s presidential field, campaigning for a job that is in many ways the chief law enforcement officer for the United States, and who would nominate Justices to serve on the Supreme Court, have come down on the supremacy of religious beliefs over our written rules of law."

Cops Kill Surrendering Man with Hands in the Air
Gilbert Flores Shooting by Bexar County Deputies Near San Antonio Sparks Outcry. ANTONIO - KSAT12 News has obtained exclusive cellphone video capturing a fatal Bexar County sheriff's deputy-involved shooting Friday in the 24400 block of Walnut Pass.
KSAT12 has made the editorial decision to freeze the video right before the shooting occurs that leads to the death of the suspect.
The video above shows the moments leading up to the fatal shots and stops just before the shots were fired. The sound from the recording continues over the freeze frame.
The video was obtained from Michael Thomas, who witnessed the shooting and contacted KSAT12.
*The video shows the shirtless suspect running through the front yard of the home.
"I was watching and wondering, what was going on, but I couldn't figure it out. I was like, with the things going on in the world, like different type of shootings with cops and different things like that, so I was like, 'Well, maybe I can catch something with my camera,'" Thomas said.
The video shows the deputies follow the man to the edge of the driveway.
"He kind of just put his hands in the air. After he put his hands in the air, they shot him," Thomas said.
The man was shot twice and died a short time afterward, the sheriff's officials said."
Former S.C. Police Chief Gets One Year Of House Arrest For Shooting Unarmed Black Man
A former South Carolina police chief has dodged prison time in the 2011 shooting death of an unarmed Black man, receiving just one year of home detention, according to NPR.
Former Eutawville, S.C. police chief Richard Combs, 38, shot and killed 54-year-old Bernard Bailey as he left the Eutawville Police Department in May 2011.
The shooting happened on May 2, 2011 when Bailey, a former prison security guard, went to the courthouse to request a change of date in his daughter’s hearing for a broken traffic light two months prior, for which Combs had given her a ticket.
Combs, believing his authority was being disrespected, was allegedly upset when Bailey — who was on the scene when his daughter was given the ticket to provide the officer with her insurance papers — arrived at the courthouse.
Without notice, Combs issued Bailey a warrant for his arrest because of their previous encounter. Witnesses say Bailey was visibly confused and angry, so he left the courthouse with Combs trailing behind him.
As Bailey tried to start his car, Combs opened the door and attempted to stop him. A physical altercation ensued and Bailey was shot three times in the chest.
Combs’ case was brought to trial twice for murder and voluntary manslaughter, but the charges were later reduced to misconduct."
*The family was awarded $400,000 from Eutawville, a town of just over 300 people, in a wrongful death lawsuit."
