Ghoulish Joni Ernst Says She'd Be Happy To Vote On A Supreme Court Nominee In A Lame Duck Session

Republican Sen. Joni Ernst told reporters Friday that even if Donald Trump and the Senate Republicans lose in November, she'd support the lame-duck Senate confirming a lame-duck appointed Supreme Court nominee before Joe Biden came to office in January. You might be asking, "is this a complete turn-around for Ernst from the last Supreme Court nomination in a presidential election year?" You are right to ask that. It is.

&quot If) it is a lame-duck session, I would support going ahead with any hearings that we might have," Ernst said during a taping of the Iowa Press show on Iowa PBS. "And if it comes to an appointment prior to the end of the year, I would be supportive of that." The question has arisen because of the announcement from Justice Ruth Bader Ginsburg that she is again getting treatment for cancer. This gleeful looking forward from Ernst is even more ghoulish when you consider what she was saying during the 9-month boycott of Merrick Garland, President Obama's failed nominee to replace Antonin Scalia.

In 2016, it was all about letting the voters have their way. "We will see what the people say this fall and our next president, regardless of party, will be making that nomination," Ernst said. "We understand that, in November if people are unhappy with the way that we have been governing in the United States Senate, they would speak out," Ernst said. "But from what we have heard, people are excited about the opportunity to voice their opinion through the ballot box, whether they're Democrats, whether they're Republicans."

John Lewis' Legacy Is the Right to Vote. And It's Under Attack.

A bill to restore the Voting Rights Act he championed has been sitting on Mitch McConnell’s desk for 225 days.

Ari Berman Senior ReporterBio

On March 1, as he was battling stage 4 cancer, John Lewis returned to Selma, Alabama, to commemorate the 55th anniversary of the Bloody Sunday march, when he was brutally beaten marching for voting rights. “We must go out and vote,” he told a crowd of thousands on the Edmund Pettus Bridge, “like we’ve never, ever voted before.” He urged the people gathered there to vote in order to “redeem the soul of America.”

The vote was personal for Lewis, who passed away late Friday evening at 80. He called it “precious, almost sacred.” He was more responsible than just about anyone for the passage of the Voting Rights Act of 1965........................

Ron DeSantis cuts off reporter asking about John Lewis’ death: ‘Do you have a question about the topic at hand?’

Published 1 min ago on July 18, 2020

On Saturday, according to the Tampa Bay Times, a reporter tried to ask Gov. Ron DeSantis (R-FL) about the passing of civil rights hero John Lewis — and was promptly rebuffed by the governor.

“We saw last night Congressman John Lewis passed away. He’s a civil rights icon,” said the reporter. “You know, this is happening amidst heated conversation in this country about race, monuments, flags.” And she tried to ask about a Confederate memorial in St. Augustine’s plaza.

“All right, yeah. I appreciate the question, but we’re trying to focus on the coronavirus,” said DeSantis, cutting off her question. “I appreciate it, but I’m going to let someone ask about — do you have a question about the topic at hand?”

Mayor Ted Wheeler said he’s aware of Wolf’s visit and wishes the Trump official hadn’t come to town.

Earlier this week, Wheeler took to Twitter to recap a conversation he had with Wolf. He said Wolf offered to help.

“I told the Acting Secretary that my biggest immediate concern is the violence federal officers brought to our streets in recent days, and the life-threatening tactics his agents use,” Wheeler wrote Tuesday on Twitter. “We do not need or want their help.”

“The best thing they can do is stay inside their building, or leave Portland altogether. Our goal is to end these violent demonstrations quickly and safely. And in the meantime, I asked him to clean up the graffiti on local federal facilities.”

Gov. Kate Brown on Thursday issued a statement calling the remarks “political theater from President Trump.” She accused Trump of seeking a confrontation in Oregon to win points in states like Ohio or Iowa.

Brown said she told Wolf that the federal government should remove “all federal officers from our streets.”.............................

Oregon Senators Demand Probe Into 'Paramilitary Assaults' By 'Occupying Army'

Source: huff post

07/17/2020 09:10 pm ET Updated 4 hours ago

Sen. Ron Wyden is demanding to know what constitutional authority the Department of Homeland Security has to snatch protesters off the streets.

Oregon’s U.S. senators and two representatives demanded an investigation Friday into “paramilitary assaults” in Portland by Department of Homeland Security forces that the lawmakers say have invaded the city and are snatching protesters off the streets in unmarked vans.

The stunned, angry reactions followed reports earlier this week that troops in military fatigues with “police” patches and no other obvious identification grabbed and detained anti-racism protesters in Portland. The squads — which were dispatched by DHS — have been manhandling protesters since at least Tuesday, Oregon Public Broadcasting reported. It’s not clear why Portland was targeted by the DHS crackdown.

Sen. Ron Wyden (D-Ore.) blasted the “paramilitary assaults” by an “occupying army.”

It’s “painfully clear this administration is focused purely on escalating violence without answering my repeated requests for why this expeditionary force is in Portland and under what constitutional authority,” he said in a statement from members of Oregon’s congressional delegation demanding an investigation. “The Office of Inspector General must investigate Trump’s assault on Americans’ constitutional rights now.”

Fellow Democratic Sen. Jeff Merkley accused Homeland Security and the Justice Department of engaging in “acts that are horrific and outrageous in our constitutional democratic republic.”

Oregon’s Democratic Reps. Earl Blumenauer and Suzanne Bonamici also supported the joint statement..................................

On July 8, the Supreme Court of the United States handed down a decision in two cases: Little Sisters of the Poor v. Pennsylvania and Pennsylvania v. Trump. The decision is the Court’s latest foray into the most litigated Affordable Care Act (ACA) issue — whether organizations that object to contraceptives for religious or moral reasons can block their employees and students from receiving contraceptive coverage through their group health plans. The Court upheld Trump administration regulations that exempt objecting organizations from having to cooperate in providing such coverage.
Background

The ACA requires insurers and group health plans to provide their enrollees with specific preventive health services without cost, including women’s services included in guidelines written by the Health Resources and Services Administration (HRSA). In 2011, HRSA designated contraceptives as one such service. Recognizing that some religious groups object to contraceptives, the U.S. Department of Health and Human Services (HHS) excluded churches and similar organizations from the mandate.

But many other entities that had religious objections were not exempted, including nonprofit hospitals, schools, universities, and charities, as well as some family-owned businesses. In 2013, HHS amended its rule to allow other religious entities to refuse to cover contraceptives. The rule required objecting organizations to certify their objections to their insurers and plan administrators. In most instances, the insurers or plan administrators were then required to provide contraceptive coverage themselves. Only nonprofits qualified for the exemption. Many nonprofits rejected this accommodation and sued, asking to be totally free from the certification requirement. Meanwhile, family businesses sued as well, asking for an accommodation of their religious beliefs. Ultimately about 100 nonprofits and businesses pursued lawsuits.

The first case to reach the Supreme Court, Burwell v. Hobby Lobby, held that the Religious Freedom Restoration Act (RFRA) entitled non–publicly traded businesses that objected to providing contraceptives for religious reasons to an accommodation. (RFRA provides that federal regulations may not substantially burden the exercise of religion unless the regulation is the least restrictive means of furthering a compelling governmental interest.) Shortly thereafter, HHS adopted an interim rule allowing objectors simply to notify HHS of their objection..........................
