The Thermonuclear Option for SCOTUS: 17 Days in January of 2017

Senate Republicans are pledging to block any Supreme Court nomination by President Barack Obama until after November, hoping a Republican will replace him and fill the vacancy left by Justice Antonin Scalia.

But even if the Senate refuses to confirm Obama's pick and a Republican wins the White House, there is one way Obama can still get his nominee confirmed.

It could all come down to 17 crucial days in January.

If Democrats win back the Senate and lose the White House in November, they would control both branches of government for about two weeks before Obama leaves office. That overlap in the transition of power is set in stone. The Constitution mandates the new Congress begins work on January 3, while President Obama stays in power until January 20.

So if Democrats take back the Senate, President Obama could send a Supreme Court nominee to that new Democratic majority, which would have 17 days to change the filibuster rules and ram in a vote before a new President takes power.

I think it is not likely to happen, but it is an interesting point of leverage. Only imagine this as Obama's farewell finger to the Reich Wing.

Denial of Legitimacy of Democratic Voters and Presidents by the Reich Wing

I remember Bob Dole saying Clinton wasn't a legitimate President because he failed to achieve 50% of the vote in 1992. Turtle McConnell saying the only priority he had was making sure President Obama failed in office. Later, the whole Birther nonsense and you lie shouts from the gallery. All of this is about silencing Democratic voices and votes. President Obama won the last election by 5 million votes. He has the Constitutional right to nominate the next Justice. To deny his nominee a vote is nothing but aftermath voter suppression.

And I whispered a second plane hit the second tower, America was under attack. That’s when the president of the United States had to step up and keep the oath of office that he took.”

Definition spectacular: beautiful in a dramatic and eye-catching way.

WTF is Card talking about. He found beauty in the crumbling of the towers, the raging fire at the Pentagon, or the smoking rubble in Pennsylvania. I always thought 9/11 was a horrible and evil act leading to untold misery. I guess the Reich Wing sees it differently.
