Judge won't force Trump to keep making ObamaCare payments

A federal court in California has struck down an emergency motion that would have forced the Trump administration to continue making ObamaCare subsidy payments to insurers.

U.S. District Judge Vince Chhabria denied the motion for an injunction.

Eighteen states and Washington, D.C., signed onto the motion for a temporary restraining order that would have forced the administration to keep making the payments while a lawsuit works its way through the courts.

For Some Youths, Minor Offenses Lead to Major Sentences in Adult Prison

Seventeen-year-old Jaylan Banks punched a guard at the Illinois Youth Center at Harrisburg as they struggled over a bottle of body wash. David Hayes, 18, spat in a guard’s face. And 18-year-old Lavell Staples was accused of shoving a guard as he tried to force his way out of his room.

A few years ago, these incidents would have cost the teenagers their privileges, earned them a stint in solitary confinement or added time to their juvenile sentences. But these young men are among almost a dozen from the Harrisburg facility who now face substantial sentences in adult prison instead, a penalty even state officials call troubling and at odds with a court-ordered push to make the juvenile justice system more rehabilitative.

Staples began serving a four-year term last month. Hayes was sentenced to six years. And Banks received eight years.

Workers at the Harrisburg facility have sought more criminal charges for staff assaults over the past two years than employees at the state’s four other juvenile facilities combined, according to records and interviews. That includes another facility with about the same number of young offenders as Harrisburg but nearly double the number of staff assaults last year.

Since 2016, the Saline County state’s attorney’s office has pursued more than 40 criminal cases against youths at Harrisburg. Thirteen of the cases were dismissed and some are pending, but nearly a dozen young men have been convicted of felony battery charges and received sentences that range from three to eight years in prison, according to court records.

Alabama elections chief wants to send citizens to prison for 5 years for voting

Alabama’s Republican secretary of state wants potentially 674 Alabama citizens who voted both in this year’s Democratic primary and Republican runoff elections, in violation of a new law, to be charged with a felony and imprisoned for five years.

Secretary of State John Merrill’s office has referred the names of 674 people who voted in the August Democratic primary and then last month’s Republican runoff to local elections officials, tasking them with investigating the list for errors. Prosecutors will then decide whether to bring charges against the individuals for violating the crossover voting ban, signed by Gov. Kay Ivey (R-AL) in May to prevent members of one party from meddling in the other party’s election.

Merrill told ThinkProgress in an interview Tuesday that he thinks the individuals who switched party affiliations should be sent to prison for five years and hit with a $15,000 fine, the maximum allowable punishment for the low-level felony.

Report: Far-right extremists are using leaked military and intelligence documents to sway elections

Extreme far-right groups across the world have united under the same banner and are actively collaborating to help influence elections and intimidate political opponents, according to a new study by the Institute of Strategic Dialogue (ISD) — and current efforts to disrupt them are lagging far behind.

The report details how far-right activists have broken through divides that for years kept them spread out, disconnected, and distrustful of each other. Now, the internet has allowed far-right groups to “actively seek to overcome ideological and geographic differences for the sake of expanding their influence, reach and impact.” A key part of that impact is coordinated grassroots activities and the weaponization of internet culture, which allows the far-right to “bring about attitude and behavioral change, in particular among the younger generations.”

One example of that international collaboration occurred earlier this year, when supporters across Europe and and the United States crowdfunded $200,000 to help far-right activists charter a 422-ton boat meant to disrupt the rescue of migrants in the Mediterranean. Donations came from France, Germany, the United States, the U.K., Italy and several other countries, and showed how “groups and individuals are prepared to put aside ideological differences… and instead focus on commonality.”

The report also noted how the far-right was using sophisticated media disruption strategies gleaned from military playbooks.

The DEA Says It Came Under Fire During a Deadly Drug Raid. Its Own Video Suggests Otherwise

The Drug Enforcement Administration has for five years steadfastly defended the behavior of its agents in a late-night drug seizure carried out with Honduran forces on the remote Mosquito Coast, a mission that resulted in the deaths of four Honduran civilians.

In the DEA’s view, the dead — one man, two women and a 14-year-old boy — were among those on a boat that shot at a canoe carrying a joint DEA-Honduran anti-drug team. The DEA said it had evidence in the form of night-vision video taken from a surveillance plane showing an “exchange of gunfire” between the two vessels after the larger boat collided with the canoe carrying the agents.

Now, for the first time, the three-hour video has been released to the public. It strongly suggests that the DEA’s account of crossfire in the May 2012 mission was not accurate. The release of the video, under a Freedom of Information Act request, follows a scathing report published by the inspectors general of the Departments of Justice and State earlier this year that challenged the DEA’s version of events.

The video shows numerous flashes of light consistent with gunshots originating from the anti-drug unit, according to Bruce Koenig, a forensic expert hired by ProPublica and The New York Times to analyze the images.

Mr. Koenig, who formerly was supervisor of the F.B.I.’s forensic audio/video group, examined the video frame by frame and concluded that only one flash originates from the passenger boat. In Mr. Koenig’s view, that flash could have been caused by a bullet striking the engine, which was later found to have a bullet hole. Infrared cameras detect heat and turn it into bright spots on video, so a muzzle flash from a gunshot and a spark from a bullet ricocheting off a metal surface can create similar flares.

Why Isnt Cable News Reporting On Attempted Murder By Neo-Nazis In Florida?

Since white nationalist Richard Spencer’s October 19 speech at the University of Florida, there has only been one mention across the three major cable news networks — CNN, MSNBC, and Fox News — that three of Spencer’s supporters were charged with attempted homicide for allegedly shooting at counter protesters outside the event.

NBCNews.com reported that three of Spencer’s apparent neo-Nazi supporters — Tyler Tenbrink, William Fears, and Colton Fears — were arrested outside of Spencer’s speech, after one of them fired “one shot, which hit a nearby building” after the others in the car urged him “to shoot at the protesters.” NBC News also noted that the supporters “displayed Nazi salutes and shouted chants about Hitler.”

Spencer is “one of the country’s most successful young white nationalist leaders” and was one of the leading forces behind the violent August 12 white supremacist and neo-Nazi rally in Charlottesville, VA, where 32-year-old counterprotester Heather Heyer was killed.

Across the three cable networks, MSNBC’s AM Joy was the only program that mentioned that the Spencer supporters were arrested after they “literally fired shots at anti-fascist protesters.” During the segment, ProPublica reporter A.C. Thompson noted that he had interviewed Tenbrink after his involvement in the Charlottesville rally, and that Tenbrink told Thompson, “‘I hate the leftists. The leftists are evil. They’re bringing degeneracy to our country. … I’m fighting against multiculturalism, the press of multiculturalism on Western society, and I’m fighting for my children.’” Thompson added, “Fast forward to this week, he shows up in Florida at the Richard Spencer event, and according to police, opens fire on counterprotesters with a handgun.”

Virginia Tech is letting a neo-Nazi teach English composition

A graduate student and teaching instructor at Virginia Tech has been discovered to be an avowed white supremacist, but university officials have yet to take any action to dismiss him.

Mark Neuhoff, who teaches English composition at the university part-time, was discovered in late September to have posted a series of racist comments on social media. “I want white supremacy,” one post read. “Whites must be in control if we are to preserve western culture. Categorically, no other race can do it.”

A group calling itself New River Valley Against Fascism obtained screenshots of Neuhoff’s social media posts and published them in a September 26 blog post. They include multiple comments about Holocaust denial, as well as one post about how Neuhoff managed to get himself banned from the infamous neo-Nazi site Stormfront for talking about the importance of having free speech in a White Nationalist society.

When asked by the Roanoke Times to explain the posts, Neuhoff said that they were an “accurate reflection of my personal beliefs.” “All of the posts are private for a specific audience who knows and understands who I am,” Neuhoff said. “What I was doing with my posts was trying to redefine the term that is destructive and shuts someone down — white supremacist.”
