If Democrats regain Congress and the White House, they will spend their time in power at war with an increasingly partisan Supreme Court. They can also learn a lot about how to fight such a Court from a law signed by Republican President George H.W. Bush.

As a U.S. Senate candidate in 1964, Bush took a deplorable position on civil rights, labeling the Civil Rights Act of 1964 — which banned employment discrimination and whites-only lunch counters, among other things — a “radical” piece of legislation that was “passed to protect 14 percent of the people.”

Bush soon abandoned these views. As a new congressman, Bush supported a ban on housing discrimination. And as president, Bush signed two significant civil rights laws — the Americans with Disabilities Act and the Civil Rights Act of 1991. While the first is better known, the second could offer a path forward to Democrats reeling from a stolen Supreme Court seat and the appointment of a man credibly accused of attempted rape to the same Court.

The Civil Rights Act of 1991 offered a swift corrective to the Supreme Court. In 1989, the Court handed down five decisions that “substantially eroded” the federal ban on employment discrimination. One of the major purposes of the law Bush signed was to override these decisions and replace them with rules more protective of civil rights (at the time, some members of the employer defense bar complained that the law reached “beyond a simple ‘restoration’ of prior laws” to enact a regime that was more protective of civil rights than the one that existed before 1989).

Axolotls in crisis: the fight to save the 'water monster' of Mexico City

The city’s floating gardens are a prime party spot – but pollution has driven the axolotl population to the verge of extinction. Can a radical plan save them?

Like many residents of Mexico City, my experience of the floating gardens of Xochimilco has mostly been tinged with alcohol. After all, every weekend, this Unesco world heritage site turns into a bacchanal, with groups aboard the canals’ iconic boats celebrating everything from high school graduations to engagements and weddings.

But this is a weekday morning, and Carlos Sumano, who is steering my canoe through the floating gardens, or chinampas, says that sort of unfettered use has taken its toll on the ecosystem. During his six years working in Xochimilco, Sumano has come across everything from pushchairs to television sets in canals.

Water pollution has also affected the region’s most unique creature: the axolotl.

When the Aztecs established themselves in the nearby city of Tenochtitlan, they found in Xochimilco what appeared to be the larva of a salamander. Fascinated, they called the animal “water monster” and incorporated it into their mythology as the mischievous and renegade brother of the god Quetzalcoatl.

Its divine character didn’t keep the Aztecs from eating it but, thanks in large part to the low-impact agriculture of Xochimilco, human and amphibian thrived.

Rightwing taskforce secretly approves anti-environment resolutions

In Washington last week, Alec, a group that links lobbyists with state lawmakers, approved measures to boost Donald Trump’s pro-fossil fuel agenda

Inside a little-known bulwark of conservative state policy, in a hotel conference room in Washington DC, state lawmakers and corporate lobbyists last week voted for a slate of anti-environment measures.

They approved resolutions supporting stripping tax benefits from electric vehicles and endorsing Donald Trump’s pro-fossil fuel energy agenda. And they voted down a proposal to limit monopoly control of the power industry, which backers said would give consumers more choice and help grow renewable electricity faster and more cheaply.

The group, a taskforce of the American Legislative Exchange Council (Alec), did so behind closed doors. They barred press from the rooms where they called roll. When voice votes were close and a tally was required, the business representatives weighing in on what kinds of policies state legislatures should pursue voted in secret. They cast ballots on paper, in a change that four sources said organizers announced was meant to keep the process confidential from reporters.

An Alec spokeswoman, Anna Tarnawski, said taskforce meetings and votes are closed to the press because “legislators are testing ideas and debating, and often are taking contrary positions for the purpose of debate and informing the conversation. They don’t want to be held to a policy declaration in the meeting because it might not necessarily be what they believe or where they’re going.”

The deliberations of a private group such as Alec, where elected officials meet out of public view with big business, highlight the divides the Republican party is struggling with as it courts both rightwing social conservatives and free-market Republicans.

Reporter finds second person who admits taking NC-09 voters' ballots on behalf of crooked GOP operat

Reporter Joe Bruno of North Carolina local news station WSOC 9 has tracked down another person who has admitted taking ballots from voters in North Carolina’s Ninth Congressional District and giving them to a GOP operative who has been convicted of felony fraud charges.

Bruno on Tuesday posted a video interview that he conducted with a North Carolina resident named Cheryl Kinlaw, who says that Republican operative McCrae Dowless paid her $100 to collect absentee ballots from certain NC-09 residents.

Instead of mailing those ballots in, however, she tells Bruno that she simply turned them over to Dowless, whom she claims had stacks of other ballots on his desk. She also says that she has no idea what happened to the ballots after she gave them to Dowless.

She also tells Bruno that she had no idea that Dowless’ actions were illegal because he’s been doing the same thing for years now.

Sully, the yellow Labrador retriever that's been seen resting loyally near former President George H.W. Bush's casket, has another mission ahead.

Bush family spokesman Jim McGrath's shared a now viral photo of the dog after the 41st president's death, saying "mission complete" on Sunday. The moving image won the hearts of dog lovers everywhere who expressed love for the pup and even defended the dog's relationship with Bush after Slate slammed the photo as not worth anyone's "emotional energy."

Tuesday, Sully visited the Capitol Rotunda, where the former president is lying in state

Bush regarded Sully as a "beautiful" and obedient companion since he joined his family in June. Monday, Sully followed Bush's casket to Joint Base Andrews in Maryland. After he says his goodbyes, Sully will go on to complete more service work, according to nonprofit America's VetDogs.

He will join Walter Reed National Military Medical Center's Facility Dog Program working alongside other service dogs, two in particular named SGT Dillon and SGT Truman, to help wounded soldiers and active duty personnel at the Bethesda, Maryland location.

NHL approves expansion team for Seattle

SEA ISLAND, Ga. —
The National Hockey League officially approved an expansion team for Seattle on Tuesday, but the first game at KeyArena may happen a year later than first thought.

As expected, the NHL Board of Governors, made up of 31 team owners from the United States and Canada, voted for Seattle to get the NHL’s 32nd franchise.

A year ago this week, Seattle Mayor Jenny Durkan announced the NHL would consider taking an expansion application from Seattle.

Ten months after that, NHL Commissioner Gary Bettman and an executive committee recommended Seattle be approved for a team. The deal was officially sealed in a Tuesday morning board vote in Sea Island, Georgia.

Durkan led the city's pitch for the NHL to choose Seattle, and it worked.

The mayor said her effort came from her heart as a hockey fan. She was one of the 25,000-plus fans who scrambled to put a down payment on tickets online.

Nielsen Keeps Job After Sucking Up To Trump On Caravan, Tough Facebook Posts

Department of Homeland Security Secretary Kirstjen Nielsen is expected to keep her job — following weeks of speculation — after publicizing her stronger stance on immigration in recent weeks, Politico reported.

A source close to Nielsen told Politico that her efforts at the U.S.-Mexico border against the caravan and her use of social media to prop up the President have bought her time. On Facebook, Nielsen posted lengthy statements in support of President Trump’s decision to send troops to the border and use tear gas on approaching migrants from the highly politicized caravan.

In a statement posted on Facebook following backlash over the tear gas usage, Nielsen took a page from Trump’s book, blasting the caravan organizers for using women and children as “human shields.”

“Instead of ‘a political stunt,’ as suggested by some, this was in fact the act of a leader concerned about the rule of law,” she said of Trump on Facebook.

Five people close to the administration told Politico that Nielsen has impressed Trump, who was considering nixing her in recent weeks because she wasn’t strong enough on immigration.

Subpoena Issued To GOP Campaign Tangled In NC Election Fraud Mess

North Carolina election officials have subpoenaed the campaign of the GOP candidate who may see his unofficial victory in a U.S. House race tossed out after claims of a potential absentee ballot fraud scheme, the Washington Post reported.


Republican Mark Harris’ campaign was subpoenaed on Monday, according the Post, while Red Dome Group, a consulting firm Harris (pictured above) hired, is expected to be subpoenaed in the days to come. State election officials and other investigators are probing anomalies in the mail-in ballot counts in the district, where the numbers were particularly outside the norm in Bladen County and Robeson County.

Bladen County reported the highest mail-in ballot return rate in the state, and Harris won 61 percent of those ballots, despite only 19 percent of them having been sent in by registered Republicans. During his primary against incumbent Republican Rep. Robert Pittenger, Harris claimed 96 percent of the mail-in ballots in Bladen County— a rate much higher than his general performance in the county.

The North Carolina State Board of Elections last week declined to certify Harris’ unofficial victory — where his lead over Democrat Dan McCready is just 905 votes — and voted to hold a hearing later this month on any potential evidence of fraud turned up in its investigation into the irregularities. The board could vote to call a whole new election.

McConnell Not Worried About Shutdown, Says Trump And Dems Need To Negotiate

Senate Majority Leader Mitch McConnell (R-KY) doesn’t think that the fight over the budget will lead to a government shutdown, asserting that if Democrats negotiate with President Donald Trump over his wall, neither party will have to shoulder the blame of a shutdown.


According to a Monday Wall Street Journal report, McConnell conceded that Democrats are “not irrelevant” due to their recently won House majority.

However, McConnell looked ahead to 2020 when he foresees an opportunity for Republicans to even further ingrain Senate gains with a favorable map and easy turnover opportunity in Sen. Doug Jones’ (D-AL) seat. McConnell euphemistically referred to the failed candidacy of Roy Moore, who was accused of sexually assaulting underage girls, “the Alabama mistake in 2017.”
