Judge complains he was lied to by feds in Clinton email suit, then retreats

Conservative group wants to question former secretary of state about email fiasco

By JOSH GERSTEIN 10/12/2018 01:10 PM EDT

A federal judge complained Friday that he was lied to by the State Department in a suit related to Hillary Clinton’s private email server, but he later backed off his claim, saying he may have been mistaken.

At a hearing on a Freedom of Information Act case about talking points related to the 2012 Benghazi attack, Judge Royce Lamberth complained that officials told the court that they had completed searching the agency’s records for information on the topic even though they knew that Clinton and other officials had used private email accounts for official business.

“The State Department told me it had produced all the records,” Lamberth complained. “That was not true at the time. It was not true. It was a lie.”

Justice Department attorney Robert Prince repeatedly interrupted, denying the judge’s claim.

GOP nominee slammed with lawsuit for voter suppression scheme

Source: Shareblue

By Dan Desai Martin - October 12, 2018

Republican Brian Kemp is trying to deny minority voters the right to vote. In Georgia. In 2018.

Georgia Secretary of State Brian Kemp, who is currently running as the GOP nominee for governor, is trying to illegally prevent minority voters from exercising their right to vote in an underhanded effort to stop his Democratic opponent Stacey Abrams from becoming the state’s first black woman governor.

Kemp, a white man, is now being sued by six civil rights organizations including the Georgia chapter of the NAACP, Asian-Americans Advancing Justice, and the Georgia Association of Latino Elected Officials. He is accused of violating the Voting Rights Act, the National Voter Registration Act, and the First and Fourteenth Amendments of the U.S. Constitution.

Kemp is named as the defendant in the lawsuit in his capacity as secretary of state, a position that puts him in charge of overseeing elections. As the Republican nominee for governor, this poses a blatant conflict of interest that has led some, including former Georgia Senator Max Cleland, to call for Kemp to step down from his current role for the duration of the campaign.

The lawsuit stems from Kemp’s use of the state’s “exact match” law to place tens of thousands of Georgia voters on a “pending” list even for very minor mistakes on voter registration forms. According to the Campaign Legal Center, the draconian measure “places tens of thousands of voter registration applications in suspense for errors as small as a misplaced hyphen, dash, or space.”

Barely more than half a century after Lewis and other activists marched across the Edmund Pettus Bridge to fight for voting rights, Republicans like Kemp are using the levers of government to try to take that right away from thousands of citizens.

McCarthy introduces bill to fully fund Trump's border wall

Source: The Hill

BY MELANIE ZANONA - 10/12/18 04:30 PM EDT

House Majority Leader Kevin McCarthy (R-Calif.) introduced a bill on Friday to fully fund President Trump's proposed border wall, a chief campaign promise that Congress has struggled to deliver.

The measure, dubbed the "Build the Wall, Enforce the Law Act," provides $23.4 billion to construct a wall along the U.S.-Mexico border, with $5.5 billion in funding available immediately.

Around $16.6 billion would be dedicated to physical barriers, while the rest would cover technology, operations and other infrastructure costs associated with border security.

The measure does not indicate where in the budget the money would come from. As an advance appropriation, it would be up to appropriators to decide where future cuts will need to come from in order to cover the costs of the bill.

"For decades, America's inability to secure our borders and stop illegal immigration has encouraged millions to undertake a dangerous journey to come here in violation of our laws and created huge loopholes in the legal channels we use to welcome immigrants to our country," McCarthy, a top Trump ally who seeks to replace retiring Speaker Paul Ryan (R-Wis.) next year, said in a statement.

Trump administration proposes tough rules on protests

Source: The Hill

BY TIMOTHY CAMA - 10/12/18 04:29 PM EDT

The Trump administration is proposing to overhaul rules for protests in front of the White House and at other iconic locations in Washington, D.C., in an effort that opponents say is aimed at shutting down free speech.

The National Park Service's (NPS) proposal, for which public comments are due by Monday, would close much of the sidewalk north of the White House to protests, limit the ability for groups to have spontaneous protests without permits in that area and on the National Mall and open the door to potentially charging some demonstrating groups fees and costs for their events.

The plan was released in August with little fanfare. But civil rights groups have been sounding alarm bells in recent days as the comment period comes to a close.

In making the proposal, the NPS cites its mandate to protect land, saying that it wants to "provide greater clarity to the public about how and where demonstrations and special events may be conducted in a manner that protects and preserves the cultural and historic integrity of these areas."

In a Blow to Labor, Teamsters Ratify UPS Contract Despite "No" Vote

BY Candice Bernd Truthout
PUBLISHED
October 11, 2018

While nonunion Amazon workers were celebrating the company’s pledge to hike their minimum wage pay to $15 an hour last week, unionized UPS workers were busy voting against a collectively bargained five-year contract with a starting pay of only $13 an hour.

By Friday, 54 percent of the 92,604 UPS workers had voted against the contract. Many were not only unsatisfied with a lower starting pay than nonunion Amazon, but also with the proposal’s creation of a new underclass of lesser-paid drivers who work weekends.

Despite this, their union, the International Brotherhood of Teamsters (IBT), ratified the largest private-sector contract in the US – covering 243,000 UPS workers – over members’ wishes that they return to the bargaining table and hammer out a better deal.

A spokesperson for the Teamsters, the nation’s largest industrial union, said the union’s own constitution triggered the proposal’s ratification because less than half of eligible union members actually cast ballots. When turnout is under that threshold, at least two-thirds of members must vote against an agreement to reject a final offer. This is known as the “two-thirds rule.”

“Only 44.3 percent of members voted and 54.2 percent opposed the agreement – triggering the constitutional provision,” the union said. “Thus, the National Master Agreement has been ratified.”

Hepatitis C Patients Are Being Forced Into Underground Buyers' Clubs

BY Elizabeth Brico TalkPoverty.org

Lisa Kaye Gray has been tired since she was 26 years old. Now 52, and a grandmother with rust-red hair and a lilting Louisiana accent, she is finally gaining the energy to help her grandson chase squirrels through the backyard. But her voice still breaks as she recalls decades marked by fatigue and muscle aches; early symptoms of hepatitis C.

“I missed out on so much,” she mourns. “Just being tired, not able to enjoy life.”

Gray acquired hepatitis C in 1991, and spent more than twenty years living with the virus’s effects. Though she didn’t begin to experience symptoms of major liver damage until 2015, she says she spent most of her life feeling fatigued, sometimes to the point of being bedridden, and nauseated.

Interferon treatment, the first available treatment for chronic hepatitis C, was introduced in 1996, but the cure rate was low; around 30 percent for genotype 1, the most common form of the virus in North America. It was also difficult to administer, requiring self-injection into the stomach, and came with a host of side-effects, ranging from nausea and muscle aches to long-term autoimmune dysfunction. The full treatment course lasted six months to a year. Gray tried interferon treatment for a month, but discontinued it when she learned she was pregnant.

“I’m glad I did,” says Gray. “I’ve heard horror stories about people who took it for the year.”

Gray is not the only hepatitis C patient who chose decades living with the virus over attempting interferon. David Cowley of Wales lived with hepatitis C for 35 years, refusing interferon because of its side effects and low success rate. But Gray and Cowley share something else in common: neither has hepatitis C anymore.

Anti-Terrorism Laws Increasingly Used to Target Indigenous Activists

BY Sandra Cuffe Truthout
PUBLISHED
October 12, 2018

The images flew around the world. The teepees. The tear gas. The Indigenous water protectors’ camps. The boots advancing in unison as security forces cracked down on protests at Standing Rock against the Dakota Access pipeline. The defiance. The hundreds of arrests.

“While Sioux leaders advocated for protests to remain peaceful, State law enforcement officials, private security companies and the North Dakota National Guard employed a militarized response to protests,” Victoria Tauli-Corpuz, the UN Special Rapporteur for Indigenous Peoples, wrote in a recent report. A mercenary firm had been surveilling the pipeline opposition movement and engaged in military-style counterterrorism measures, according to an investigative report published by The Intercept.

The use of counterterrorism tactics against Indigenous protesters in the US reflects a global trend. But in many parts of the world, and particularly in Latin America, Indigenous leaders and activists are also openly and explicitly criminalized as terrorists. The use of anti-terrorism and national security legislation and policies against Indigenous activists is becoming more and more common.

Ill-Defined Anti-Terrorism Laws Permit Targeted Criminalization
“Several of the countries that I’ve been to, and from the communications I’ve received, have indicated that the anti-terrorism act or the national security act is the one that’s being used more against Indigenous peoples,” Tauli-Corpuz told Truthout. With laws defining terrorism in a vague manner, governments can consider blockades against logging companies to be terrorist acts, for example, she said.

“It’s easy to put that under the umbrella of terrorism. That’s a big problem that it’s in the hands of governments that have several laws that they can just use to trump up charges against Indigenous peoples and now they have even more possibilities to do that because of the anti-terrorism acts,” said Tauli-Corpuz. “The coming into being of these anti-terrorism laws is exacerbating the situation of impunity and criminalization of Indigenous peoples.”

Mitch McConnell: Anyone who disagrees with me is 'toxic'

By Eric Boehlert - October 12, 2018

The party infamous for encouraging political violence is now calling its opponents 'toxic' and 'fringe.'

Republicans, led by Sen. Mitch McConnell (R-KY), are now campaigning on the idea that Democrats nationwide represent a dangerous mob of protesters at odds with the United States.

Having long ago abandoned any idea of running on taxes and health care this election cycle, anxious Republicans are left with little more than scare tactics to motivate their supporters.

The ongoing pity party is a continuation of the GOP’s public relations campaign to paint activists who protested Brett Kavanaugh’s Supreme Court nomination as being dangerous and unhinged.

“Only one side was happy to play host to this toxic fringe behavior,” McConnell whined on Thursday. “Only one side’s leaders are now openly calling for more of it.”

But the GOP claim that progressive activists have descended into mob tactics doesn’t match reality.

GOP lawmaker forced to pay $30,000 for removing anti-Trump sign

By Oliver Willis - October 12, 2018

Wisconsin lawmaker Dale Kooyenga incurred the $30,000 fine after removing a permitted sign he didn't agree with.

Wisconsin assemblyman Dale Kooyenga, a Republican, is forced to pay the $30,000 settlement he brought on himself by improperly removing an anti-Trump sign.

Kooyenga is currently running for the seat in Wisconsin State Senate’s 5th District, which includes parts of Milwaukee and Waukesha counties.

A controversy was touched when Kooyenga removed a sign placed in the state Capitol describing (admitted sexual predator) Trump as a “serial groper” and “corrupt.”

The man who put the sign there, Donald Johnson, had a state permit to put it up, and attached a copy of his permit to the back of the sign. Despite that, Kooyenga removed the sign and kept it in his office. Capitol Police discovered that it was Kooyenga after reviewing security footage showing the incident.
