Judge blocks tax cut rule in American Rescue Plan

MONTGOMERY, Ala. (AP) — A federal judge has blocked the U.S. Treasury from enforcing a provision of the American Rescue Plan Act that prohibited states from using the pandemic relief funds to offset new tax cuts.

U.S. District Judge L. Scott Coogler ruled Monday in Alabama that Congress exceeded its power in putting the so-called tax mandate on states. He entered a final judgement in favor of 13 states that had filed a lawsuit and instructed the Treasury Department not to enforce the provision. The judge left the rest of the law in place.

The American Rescue Plan steered $195 billion in flexible relief funds to states but specified that states could not use it as a means to cut taxes by using the federal relief dollars to offset the revenue reduction.

The judge described the tax-cut restrictions as “a federal invasion of State sovereignty" that was “unconstitutionally ambiguous" — leaving states guessing as to whether their tax cuts would trigger a repayment of federal funds.

I can't tell the difference between pumpkin pie and sweet potato pie

WV voters slam Biden, approve of Justice, Manchin in latest MBE Research poll

CHARLESTON, W.Va. — New survey results show President Joe Biden’s rating is low among West Virginians, while more than half of state residents strongly approve of Gov. Jim Justice’s job performance.

Biden’s overall approval rating was 32 percent and disapproval rating was 65 percent.

About 69 percent of West Virginia voters are applauding Gov. Justice for his work since taking office in 2017. His disapproval rate was 28 percent.

U.S. Senator Joe Manchin (D-W.Va.) has an overall job approval rating of 60 percent compared to Biden’s 32 percent.

New York, NY (CNN)Elon Musk is trolling again on Twitter, and this time his target is Sen. Bernie Sanders.

"I keep forgetting you're still alive," Musk tweeted Sunday morning, in response to Sanders tweeting that the extremely wealthy should pay their fair share of taxes. CNN Business has reached out to Sanders for comment.

"Want me to sell more stock, Bernie? Just say the words..." Musk tweeted an hour later.

Musk ended the week selling a grand total of $6.9 billion worth of Tesla shares. That only amounted to less than 4% of the shares he holds directly, and less than 3% including all the options he owns to buy additional shares.

Senate Minority Leader Mitch McConnell said that the final version of the Democrats' $1.75 trillion "Build Back Better" social spending bill will be "written by Joe Manchin and Kyrsten Sinema," the two moderate Democrats that have frustrated progressives with various objections to the legislation central to President Joe Biden's agenda.

"The House bill will come over, [Senate Majority Leader Chuck] Schumer will offer a substitute, and the substitute will be written by Joe Manchin and Kyrsten Sinema," he said. "If there is no substitute, it would mean that neither of them got on board."

The Kentucky Republican made the remarks in an interview on "Flyover Country with Scott Jennings," a podcast hosted by conservative media consultant Scott Jennings, that was released on Friday.

McConnell sought to defend his vote in favor of a bipartisan infrastructure bill that passed the House last week, which garnered 19 Republican votes in the Senate in August but just 13 Republican votes in the other chamber last Friday. Those 13 Republicans now face calls to lose their committee assignments and threatening calls from constituents.

Mayor-elect Adams calls on Dems to condemn BLM leader’s ‘riot’ threat — but activist claims ‘this a political circus’

Mayor-elect Eric Adams dared national and local Democrats on Friday to condemn a Black Lives Matter leader who said the incoming mayor’s policies on policing will trigger “riots” and “bloodshed” in the city — but the activist behind the threat claimed Adams is creating a “circus” instead of focusing on the issues.

Adams — who drew the threat over his plan to as mayor reinstate the NYPD’s plainclothes cop units — said he’s perplexed by the silence from prominent Democrats in the face of the heated comments from BLM activist Hawk Newsome.

“I have no idea,” Adams said at a press conference in Brooklyn when asked why more members of his party haven’t spoken out against Newsome. “I think that this is an excellent moment for the local and state and federal Democratic Party to state: We could have justice without violence.”

Highlighting Newsome’s focus on “bloodshed,” Adams continued: “National, state and city electeds should stand up and say, ‘we will never allow anyone to make those comments,’ that there will be blood in our streets, because you know where that blood ends up? In the streets of our community.”

NYC is getting its own city coin in line with the incoming mayor's crypto hub vision

New York City is about to get its own digital token in line with the vision of Mayor-Elect Eric Adams to transform the Big Apple into a cryptocurrency hub.

The coin is called NYCCoin and is being launched by CityCoins, a civic-minded community and open-source protocol that gives investors an avenue to support their cities by expanding their crypto treasury while earning for themselves. When bought or mined, it allocates 30% of its reward to the city.

NYCCoin's launch follows close behind MiamiCoin, which to date has earned more than $21.3 million for the city of Miami since its August 2020 launch, the community said.

While Austin, Texas was a close contender, the community eventually chose New York, propelled by the incoming mayor's pro-crypto stance, Patrick Stanley, a CityCoins community lead, told Insider.

Max Cleland dies; senator and veteran lost limbs in Vietnam

ATLANTA -- Max Cleland, who lost three limbs to a hand grenade in Vietnam and later became a groundbreaking Veterans Administration chief and U.S. senator from Georgia until an attack ad questioning his patriotism derailed his reelection, died on Tuesday. He was 79.

Cleland died at his home in Atlanta from congestive heart failure, his personal assistant Linda Dean told The Associated Press.

Cleland was a U.S. Army captain in Vietnam when he lost his right arm and two legs while picking up a fallen grenade in 1968. He blamed himself for decades, until he learned that another soldier had dropped it. He also spent many months in hospitals ill-equipped to help so many wounded soldiers.

Fellow veterans cheered when President Jimmy Carter appointed Cleland to lead the Veterans Administration, a post he held from 1977 to 1981. The VA and the wider medical community recognized post-traumatic stress disorder — what had been previously been dismissed as shell-shock — as a genuine condition while Cleland was in charge, and he worked to provide veterans and their families with better care.
