Federal judge rules 'QAnon shaman' too dangerous to be released from jail

Jacob Chansley, the self-proclaimed "QAnon Shaman" who participated in the Jan. 6 riot at the Capitol, will not be released from jail ahead of his trial, a federal judge determined on Monday.
In court documents cited by CNN, Judge Royce Lamberth argued that Chansley's statements holding former President Trump accountable for his alleged illegal entry into the Capitol building showed that Chansley was unremorseful about his actions.
"The court finds that no condition or combination of conditions of release will reasonably assure defendant's appearance as required [in court] or the safety of others and the community," Lamberth ruled.
"Defendant characterizes himself as a peaceful person who was welcomed into the Capitol building on January 6th by police officers. The Court finds none of his many attempts to manipulate the evidence and minimize the seriousness of his actions persuasive," the judge continued.

U.S. House panel reissues subpoena for Trump's tax records

(Reuters) - A U.S. House of Representatives panel has reissued a subpoena seeking Donald Trump's tax and financial records, saying in a memo made public on Tuesday it needs the documents to address "conflicts of interest" by future presidents.
In a court filing on Tuesday, House lawyers told a judge that the House Oversight Committee reissued a subpoena to Trump's accounting firm, Mazars USA LLP, on Feb. 25.
The committee issued a similar subpoena in 2019, but that subpoena expired in January when new U.S. lawmakers took office.
Tuesday's court filing included a Feb. 23 memorandum from the committee's chairwoman, Representative Carolyn Maloney, explaining to colleagues the decision to reissue the subpoena.

The Manhattan District Attorney's Office has added a prominent former prosecutor to bolster its team investigating possible fraud claims against former President Donald Trump and his company.
Mark Pomerantz, a former federal prosecutor in Manhattan and a well-regarded defense lawyer and trial attorney with an expertise in financial institutions, was sworn into office earlier this month as a special assistant district attorney, Danny Frost, a spokesman for District Attorney Cy Vance, told CNN.
Vance's office is investigating whether the Trump Organization violated state laws and is looking into the legality of tax deductions, including from conservation easements and consulting fees the company took, as well as what the Trump Organization told lenders and tax authorities about the value of its assets.

Pomerantz was the head of the criminal division at the US attorney's office in Manhattan from 1997 to 1999. He had been a partner at Paul Weiss for more than a decade until he retired. As a defense lawyer he represented numerous individuals and financial institutions in complex financial fraud investigations.

With impeachment over, 9/11 probe leaders lend weight to calls for an independent commission to investigate Capitol attack
With the second acquittal of former president Donald Trump by the Senate, the two leaders of the commission that examined the 9/11 attacks are looking ahead to the next possible chapter, lending their influence to calls for a commission with a mandate to investigate fully the Jan. 6 insurrection at the Capitol.
Saturday’s 57 to 43 vote brought an end to Congress’s formal effort to hold Trump accountable for what happened last month.
But the Senate vote left multiple questions still to be answered, including some that the president’s legal team deflected during the trial. Chief among them: Exactly what did Trump know as the attacks were unfolding, and why he didn’t he do anything to protect Vice President Mike Pence or order immediate reinforcements to the beleaguered law enforcement officers at the Capitol?
Trump could yet face judgment in court, whether criminal or civil, but the full story of what happened and how it happened remains untold. A traumatic moment for the country will not quickly fade, nor should it, not after an attack on the symbol of democracy and democracy itself.

One of Washington’s leading conservative constitutional lawyers publicly broke on Sunday with the main Republican argument against convicting former President Donald J. Trump in his impeachment trial, asserting that an ex-president can indeed be tried for high crimes and misdemeanors.
In an opinion piece posted on The Wall Street Journal’s website, the lawyer, Charles J. Cooper, who is closely allied with top Republicans in Congress, dismissed as illogical the claim that it is unconstitutional to hold an impeachment trial for a former president. The piece came two days before the Senate was set to start the proceeding, in which Mr. Trump is charged with “incitement of insurrection” in connection with the deadly assault on the Capitol by his supporters on Jan. 6.
Since the rampage, Republicans have made little effort to excuse Mr. Trump’s conduct, but have coalesced behind the legal argument about constitutionality as their rationale for why he should not be tried, much less convicted. Their theory is that because the Constitution’s penalty for an impeachment conviction is removal from office, it was never intended to apply to a former president, who is no longer in office.
Many legal scholars disagree, and the Senate has previously held an impeachment trial of a former official — though never a former president. But 45 Republican senators, including Mitch McConnell of Kentucky, the minority leader who is said to believe that Mr. Trump committed impeachable offenses, voted last month to dismiss the trial as unconstitutional on those grounds.
