Lawyers who sue Lawyers

From the Malpractice Lawyers Network, “lawyers who sue attorneys, accountants and fiduciaries”:

Rule 3.3 of the ABA Rules of Professional Conduct says lawyers “shall not knowingly” make false statements to a court or offer evidence that the lawyer knows to be false. The latter means even if the lawyer doesn’t lie, he cannot let his client lie either.

Rule 3.4 says that “a lawyer shall not… falsify evidence, counsel or assist a witness to testify falsely, or offer an inducement to a witness that is prohibited by law…”

Finally, Rule 4.1 says, “In the course of representing a client a lawyer shall not knowingly:
(a) make a false statement of material fact or law to a third person…”

Marjorie Traitor Green ISN'T the worst.

While she is terrible in most every evil way, there is a member of Congress who’s actions are even lower during the riot of seditionists at the Capitol.

I refer to Rep. Lauren Boebert, who reported Speaker Pelosi’s location in real time.

(Boebert) first shared that the lawmakers had been moved to the House chambers. Then, she tweeted out the "Speaker has been removed from the chambers."

Florida man Douglass Mackey, a notorious white nationalist and right-wing social media troll, was arrested this week on charges of conspiring with others to deprive citizens of their right to vote ahead of the 2016 election, the Department of Justice announced on Wednesday.

"According to the allegations in the complaint, the defendant exploited a social media platform to infringe one of the most basic and sacred rights guaranteed by the Constitution: the right to vote," Nicholas McQuaid, acting Assistant Attorney General of the Criminal Division, said in a press release. "This complaint underscores the department's commitment to investigating and prosecuting those who would undermine citizens' voting rights."

It also suggests that the Russia investigation, at least in part, survived the tenure of former Attorney General Bill Barr.

According to the complaint, Mackey's Twitter account had nearly 60,000 followers, and in February 2016 the MIT Media Lab ranked him 107th in its list of the most influential personalities ahead of the election, higher than NBC News and Stephen Colbert. Prosecutors say that in the months before the election, Mackey collaborated with unnamed co-conspirators to encourage Hillary Clinton supporters to cast votes via text messages or social media — which are not viable or legal voting methods in any state.

The conspiracy charge against Mackey, who was arrested in West Palm Beach, could indicate that the Justice Department has been probing a broader network. Three of his co-conspirators were identified by HuffPost reporter Luke O'Brien, who wrote an in-depth 2018 profile of Mackey: white nationalist financier Jeff Giesea; conspiracy theorist Mike Cernovich, who has ties to onetime national security adviser turned QAnon hero Michael Flynn; and Jack Posobiec, a far-right provocateur with ties to neo-Nazi groups and longtime Trump confidant Roger Stone. The pro-Trump group, who called themselves "MAGA3X," fueled the Pizzagate social media campaign that smeared Hillary Clinton and other Democratic leaders in the run-up to the 2016 election.

For Bannon and his allies, purging extremist elements from the far-right movement is hard, because no matter how vocally they repudiate neo-Nazis and their brethren, those groups will hug back harder—especially if there’s a national platform for them to clamber on. “David Duke shows up for every media opportunity,” Bannon complained to Rose, referring to the former K.K.K. grand wizard. One person who met with Bannon recently described him as furious and preoccupied with the Nazi problem. “What the fuck do we do about the Nazis?” he asked at one point during their meeting, according to this person.

Complicating the issue are the rank-and-file Web-based Breitbart constituency that Bannon calls the “Pepes,” after the cartoon frog often used in memes promoting far-right ideology. It has not always been clear where the group’s mischief-making ends and anti-Semitism begins: the “Pepes” themselves gleefully Photoshop their foes into gas chambers, not because they actually believe in white supremacism, some say, but because they simply wanted to see the liberal Internet lose their minds. The Pepes’ outrageous stunts are responsibly in part for fueling the rise of Breitbart, and to an extent, Trumpism, but their refusal to stop tweaking progressives with their use of swastikas has now become a liability.

“Bannon sees the Pepes as kind of like trolls, and not like the Nazis like Richard Spencer and David Duke,” explained the person who spoke to Bannon. “Everybody’s kind of struggling with it. Like, ‘Oh yeah, there’s these people, they’re kind of trollish, they make a lot of jokes or whatever, maybe we wish they were a little bit nicer.’ But that’s different, categorically, than neo-Nazis at rallies throwing Nazi salutes and throwing up Nazi flags.”

Near the top of this heap of problems, however, is Bannon himself. After immortalizing Breitbart as a “platform for the alt-right” during the 2016 Republican National Convention—a slip of the tongue several of his colleagues wish he hadn’t made, in retrospect—Bannon inadvertently linked his site to Spencer’s white nationalist movement. The budding fascist had dubbed his own movement the “alt-right” back in 2010, using it to describe a movement dedicated to marginalizing Jews and minorities from white nations, establishing authoritarian governments, and rolling back equal rights for men and women. And Bannon’s apparent reticence to repudiate hate groups, like William F. Buckley did when he rejected the John Birch Society during the 1960s, only allowed them to grow.

Craig Unger talks about It.

Haven’t listened to the whole thing, but, wow.

Unger is a veteran journalist and author of six books, including the New York Times bestsellers House of Bush, House of Saud, and House of Trump, House of Putin.

Unger writes that Trump was rescued multiple bankruptcies by millions in Russian cash laundered through his real estate in the 80s and 90s.

The grooming included an invitation to Russia by a high-level KGB official in 1987 under the guise of a preliminary scouting trip to build a Trump hotel in Moscow. Unger says the trip, was in fact ‘deep development’ by KGB handlers that furthered creating secret back channels and allowed the Russians to influence and damage American democracy, the author claims.

Browning’s essay covers many topics, ranging from Trump’s “America First” foreign policy — a phrase most closely associated with a group of prewar American Nazi sympathizers — to the role of Fox News as a kind of privatized state propaganda office. But the most interesting part of his argument is the comparison between Senate Majority Leader Mitch McConnell and Paul von Hindenburg, the German leader who ultimately handed power over to Hitler. Here’s how Browning summarizes the history:

Paul von Hindenburg, elected president of Germany in 1925, was endowed by the Weimar Constitution with various emergency powers to defend German democracy should it be in dire peril. Instead of defending it, Hindenburg became its gravedigger, using these powers first to destroy democratic norms and then to ally with the Nazis to replace parliamentary government with authoritarian rule. Hindenburg began using his emergency powers in 1930, appointing a sequence of chancellors who ruled by decree rather than through parliamentary majorities, which had become increasingly impossible to obtain as a result of the Great Depression and the hyperpolarization of German politics.

Because an ever-shrinking base of support for traditional conservatism made it impossible to carry out their authoritarian revision of the constitution, Hindenburg and the old right ultimately made their deal with Hitler and installed him as chancellor. Thinking that they could ultimately control Hitler while enjoying the benefits of his popular support, the conservatives were initially gratified by the fulfillment of their agenda: intensified rearmament, the outlawing of the Communist Party, the suspension first of freedom of speech, the press, and assembly and then of parliamentary government itself, a purge of the civil service, and the abolition of independent labor unions. Needless to say, the Nazis then proceeded far beyond the goals they shared with their conservative allies, who were powerless to hinder them in any significant way.

McConnell, in Browning’s eyes, is doing something similar — taking whatever actions he can to attain power, including breaking the system for judicial nominations (cough cough, Merrick Garland) and empowering a dangerous demagogue under the delusion that he can be fully controlled:

Sorry, that's not how I remember it.

AOC proposes liberal policies, what I consider mainstream New Deal economics and what she has termed Democratic Socialism, like universal health care and a living wage for all who work.

It sickens me to see so many in post-Reagan America now consider ideas that help ALL Americans lead better lives so far out of the mainstream they are impossible to even contemplate, let alone achieve through legislation.
