He can fire pretty much anybody in a leadership position but it can't be to cover up a crime. That is why the memo comes into play. If it can be shown Rosenstein is not performing his duties competently then Shitgibbon is within his rights to fire him.

Shitgibbon has a problem. He has no credibility nor does Nunes so Mueller will be handed another piece of obstruction evidence upon Rosenstein being fired.
