Until she files a complaint, no investigation.

And even than, if they say events happened differently enough they can claim to have been the ones there but that she came in wilingly and was consenting and she changed her mind.

“Hey, she came in willingly, we were making out, she was acting like all was good then suddenly she started yelling so we let her leave”

They say that and they are placing themselves there without admission of any crime:

Then to charge or prosecute it’s down to who appears more credible. Well to charge him you must go off her testimony and admit she identified the wrong persons along with not remembering many other details- not very credible to a jury. Then you have his account voluntarily coming forward when he didn’t have to.

So with the right version of events told by these guys the chances of prosecution are pretty much zero.
