2. This would suggest that budgeting is real time, rather than fiscal year...

If it is like most Federal agencies, they are operating off a funded budget until Oct 1. Obviously, there would be leverage for the 2020 fiscal year budget, but unless DOJ is quite different, I'd think there is no way to cut funding already appropriated.
