(26,044 posts)...which holds that the letter of the Constitution empowers state legislatures to pick electors, meaning that they can intervene on their own at any time without changing the states law (the latter of which would require a governors signature). And, if state law provides the choice to be made by the voters, that state law is overruled by the Constitution, which gives it to the state legislatures on their own.
The problem with that understanding is that the Constitution ALSO provides that, when two rival slates of electors are named from a given state, Congress shall give the nod to which should be recognized. And, if Congress cant agree (which would be the case with a Democratic House), the same provision states that the slate certified by the governor gets chosen. So, they can only make a difference in two of those states, not enough to sway the outcome.
