1. It doesn't really matter. Here's why:

The man was installed as a General Counsel. As such, he will only have access to any classified information on a "need-to-know" basis. He will never "need to know" anything of any importance, nor will he be able to make any policies.

The NSA is expert at stashing political appointees away where they can do no harm. The job is really just a sinecure. He could stay there until retirement without every seeing anything classified higher than SECRET.
