It's federally illegal. Some states legalized it. The federal government still has a right to overturn state legalization, but Obama is fine with it. A Justice's opinion is just that. They aren't lawmakers. Hate to quote Roberts, but he correctly said a Justice should be an umpire (even though he usually doesn't follow this himself).

Unless you think banning it violates the right to privacy?
