The courts don't appear to even be looking at what the appropriate public policy should be. It's entirely a question of who has the authority to make policy in that area. State legislatures and Congress have acted in similar ways to restrict evictions during the pandemic and the courts don't seem interested in weighing in on that. They certainly could do so again in the event of another pandemic (or resurgence of the current one).

I had to sell to another business name. The moratorium only applies to non pmt of rent.
