"Albertsons said Wednesday that Kroger “willfully” breached the merger agreement by refusing to divest assets needed for antitrust approval, ignoring feedback from regulators and rejecting stronger divestiture buyers, among others." I'm looking forward to reading that Complaint as well as the factual recitation (and evidentiary statement) which will surely accompany the Plaintiff's Opposition to the Motion to Dismiss that Complaint.
