What I am saying is that some groups planned to do it (the existence of the gallows makes that apparent), but that there might not have been a centralized plan that everyone in the mob knew about beforehand and intended to carry out. Kirschner's point is that it would be much easier to prosecute TFG for inciting the insurrection if there hadn't been a single centralized plan beforehand and that it was his rally speech that motivated most of them to enter the Capitol with the intent to stop the proceedings. Otherwise he could argue that he had nothing to do with any of it (which is what he is, in fact, claiming) because it was all planned by the participants long before 1/6.
