Former Upstate Medical president agrees to repay $100,000 in unauthorized pay [View all]

Syracuse, N.Y. -- The former president of Upstate Medical University has agreed to repay nearly $100,000 he received in unauthorized compensation under the terms of a settlement with the State University of New York, according to documents obtained by syracuse.com.

Dr. David R. Smith, 60, of Fayetteville, who stepped down as president Nov. 15, also agreed to resign from his faculty position at Upstate Oct. 1. Under SUNY policy, Upstate had to keep Smith on as a professor because every campus president must be allowed to continue working as a faculty member upon leaving the presidency.

Smith's salary as president was $363,000 a year. He also received $250,000 a year from the SUNY Research Foundation. His pay was reduced to $205,558 when he became a faculty member.

A source said the settlement will have no effect on an FBI investigation into compensation Smith got from two companies that do business with the hospital and medical school. Smith has not been charged with any crimes.
