Judge stays abortion law that defunded Planned Parenthood

A federal judge has halted enforcement of a law cutting off funding to Planned Parenthood of Indianaand other entities that provide abortions.

The ruling by U.S. District Judge Tanya Walton Pratt on Friday night means Planned Parenthood, which stopped serving its 9,300 Medicaid patients last week after running out of donated funds, can again see those patients.

The judge also enjoined a part of the law that would have taken effect July 1, requiring doctors to tell patients seeking abortions that a fetus can feel pain at 20 weeks or less.

Both were part of an anti-abortion bill that passed the Republican dominated legislature with significant support and was signed into law by Mitch Daniels.

5. I wouldn't be so quick to celebrate. This case is primarily about

funding and the USSC ACORN ruling is likely to apply here as well.

PP is not prevented from seeing any patients - it only has to do with the government funding them to do so. A provider is always free to provide pro bono services.

As a practical matter, providing services costs money.

Also as a practical matter, nut jobs bomb clinics and kill providers.

Risking your life AND going out of pocket are heavy burdens to provide something that is supposed to be a constitutional right of women require an awful lot of commitment.

What if we put that kind of burden on some other Constitutional right, like, oh, I don't know....religious freedom? We'd never hear the fricking end of it. (Meanwhile, despite the Establishment Clause, government money goes to religion in any number of ways, but God help anyone who deviates one iota from the Hyde Amendment.)

Women need to "act up," IMO.

Meanwhile, I'm more than fine with celebrating a judge's decision to uphold the Constitution.

"INDIANAPOLIS – Planned Parenthood of Indiana expects to start offering services to Medicaid patients again Saturday after a federal judge ruled the state is not allowed to cut off the organization's public funding for general health services solely because it also provides abortions.
U.S. District Judge Tanya Walton Pratt's ruling Friday blocked parts of a tough new abortion law and granted Planned Parenthood of Indiana's request for an injunction on the state's move to defund the organization. The decision sides with federal officials who said states cannot restrict Medicaid recipients' freedom to choose their health care provider or disqualify Medicaid providers merely because they also offer abortions.
Indiana attorney general's office spokesman Bryan Corbin said the state likely will appeal.
Planned Parenthood of Indiana has been without Medicaid funding since May 10, when Republican Gov. Mitch Daniels signed the law that cut off about $1.4 million and made Indiana the first state to deny the organization Medicaid funds for services such as breast exams and Pap tests."

16. Federal Judge Rules Indiana Can't Block Planned Parenthood Funding

A federal judge has granted Planned Parenthood a temporary injunction against an Indiana law that stripped it of all federal funding in the state.

"If dogma trumps pragmatism and neither side budges, Indiana's most vulnerable citizens could end up paying the price as the collateral damage of a partisan battle," U.S. District Court Judge Tanya Walton Pratt wrote in her decision.

In May, Gov. Mitch Daniels (R) signed a law that blocked all federal funds from going to Planned Parenthood, on the grounds that it performs abortions.

Planned Parenthood had asked for a preliminary injunction, arguing that when the law went into effect on June 20 it cut about $1.4 million funding that goes to Medicaid recipients, and would consequently cut health care services for around 9,000 people.
