SF Chronicle(10-14) 12:45 PDT SUNNYVALE -- No criminal charges will be filed against a group of former De Anza College baseball players accused of gang raping a 17-year-old girl at a San Jose house party in March 2007, prosecutors said today.
"The defendants' behavior was not acceptable conduct in a civilized society," said Santa Clara County District Attorney Jeff Rosen. "However, the district attorney's office cannot prove that a crime occurred on March 3, 2007, and therefore will not file criminal charges."
The alleged victim was Jessica Gonzalez, now 22, who has chosen to step forward to reveal her identity. Gonzalez said that as many as nine men sexually assaulted her at the party at a San Jose-area house.
Gonzalez said several members of the De Anza baseball team took turns raping her while she was unconscious as a result of being intoxicated. Three young women who were members of the De Anza women's soccer team said they had rescued her from the attack.
