Scott Winfield Davis is doing most everything he can to drop out of the governor's race. But despite his efforts, a state official says Davis' name will still grace the October ballot. Davis announced his withdrawal late Tuesday, after the Mercury News learned that the Palo Alto resident remains the "top suspect" in an unsolved slaying-arson in Atlanta, even though charges against him were dropped years ago.
The erstwhile candidate -- who said he's innocent -- has shuttered his campaign Web site. And he has e-mailed the Mercury News, saying he's departing for a brief vacation and will not speak to the media.

Davis is only on the "recall or not recall" part of ballot. By law, Governor Davis is not allowed to be on the 2nd part.

By law, Governor Davis is not allowed to be on the 2nd part.
but some voters might be unaware of that fact, or might think the law had been changed.
and, how many people know that Gray is not Gov Davis's real name? how many people know what his real name is?

but he needs to be gotten under oath and asked if he was promised anything (re: his legal problems) if he would get on the ballot.
maybe a surprise wham-bam would elicit a surprising (and indictable) response.

... if Steve Davis gets a significant number of votes, you know it'll be due to voter confusion, like in FL 2000 where the butterfly ballot design gave Pat Buchanan thousands of undeserved votes.

He claims that the voters are smart.
If they are, then they would probably see that this recall election is a sham, and that the machinations of the Republican governor and the energy companies were the ones who got the state in such terrible shape to begin with.
