3. I caught that ... somehow missed almost all of the hearing... but caught

that interchange. Durbin seemed absolutely dumbfounded at first... and then increasingly enraged at Ashcroft's response and the gall taken. Along with intentionally not claiming executive priveledge (which can be challenged in court)... but claiming it via his excuses... when asked if all of the memos not released were "classified"... Ashcroft engages in a lengthy conversation with his aides... and then procedes to ignore the question altogether. Durbin was having none of it.
