Holy cow, BushCo just nominated a guy for a cabinet post for whom there was an active arrest warrant! And they wanted the guy to be the head of the agency concerned with national security!

Don't try to minimize it because it's only civil, not criminal.

The person nominated to head up Homeland Security had an arrest warrant hanging over his head. Meaning if he ran a red light and they ran his driver's license, he'd be spending the night in jail.

I think an arrest warrant is always in connection with a crime. Civil matters stay in court and court alone. I don't think there's any such thing as a civil arrest warrant.

Essentially it is a coercive power by the judge to get you to cooperate in a lawsuit. You get locked up until you post a bond or next time the court is in session.

"Rule to show cause" is for you to show up in front of the judge to show cause why you should not be held in contempt of court. If you do not show, then you are in contempt of court and a body attachment order is issued. This is the same as an arrest warrant. Your body is attached by the court. The court could send a deputy out to get you or just have the attachment/warrant pend until you are picked by (usually on a unrelated traffic stop) you come back as having a warrant and you get to spend the night in jail. The warrant is for contempt of court, not anything in the civil action.

But that is IL, not NJ. I have no idea what the law is in NJ.

The difference between a civil matter and criminal matter is that you can't be jailed for civil offenses.

But if there were not criminal laws requiring people to show up for court, people would just ignore all civil court orders and transfer all their assets to their children or parrents.

Bottom line: Kerik is at risk of being charged with a criminal offense.

That's what contempt of court is. That's what happens when you don't show up for court at all.
