The DeLay game plan is to get the case transferred to a better trial venue, and this is an effort to corrupt the jury pool. By running the ads, they plant the attack stories, and either way they benefit.

If the case doesn't get moved, they've helped to prejudice the jurors. If it gets moved, they have a more favorable place to get DeLay tried.

I will predict the judge may call the DeLay attorneys and forces to task for this. The judge may consider this a bald attempt to impact the jury pool, and he would be right.

They are targeting Austin, so that means the media buy is aimed at influencing THAT market, not others. To me, that is what nails them. If I were Earle, I'd subpoena the people who ran the ad and paid for it. If they want a seat at the defendants' table, give it to them.
