Poll question: Mike Brown Poll: Please Read

Although Mr. Brown has stepped down, to the best of my knowledge, he remains a consultant to FEMA at a salary many of us could only dream of. Further, it seems that he has paid no penalty sufficient to the gravity of his failures.

I believe that this is disgraceful. Further, as a man who has held several supervisory positions in the Blue Collar realm, I can tell you that if a failure of my competence and leadership had led to one single fatality, I would assuredly spend time in prison.

Which brings me to my poll:


Based on your personal knowledge of Mike Brown's competence or lack thereof, do you believe that he should be prosecuted for criminal negligence?

1. What is needed for a criminal negligence charge?

If criminal negligence means he intentionally made decisions that he knew would cause people to die and suffer, then no. I don't think the man is evil. Just seriously incompetent. A boob if you will.

I'm not sure you could prosecute him for being an idiot.

6. As far as I understand it

The charge would mean that he was willfully negligent in a position where his negligence could lead to death and suffering, not that he made decisions he knew would cause death and suffering. That would be more premeditated.

They've charged the bus driver in the evacuee fire for negligent homicide, for instance, for not doing what he could to prevent the fire. They are going after the people responsible for the maintenance of the bus, too. Not because their intention was to hurt anyone, but because their intention was to neglect a duty that would have prevented the accident from happening.

Make it seem less like incompetence, more like arrogance. He didn't believe it was his job to coordinate or handle the actual work, and his arrogance kept him from doing anything. That's evil, in my book.

3. He should be prosecuted for perjury..

before Congress, when he lied about why the southern parishes of Louisiana were not included in the first declaration of a state of emergency. He said that Blanco left them out--it was a blatant lie designed to cover his ass.

As far as I know, negligence does not need to be intentional in many cases.

In higher levels, it can be prosecuted as a breech of an oath of conduct. That is one reason why govt. officials are often "sworn in."
