Of course, their argument is not that the president has the inherent power to authorize domestic surveillance anytime he wants, only that he has that power during wartime. And as near as I can tell, that's the elephant in the room that no one is really very anxious to discuss: What is "wartime"? Is George Bush really a "wartime president," as he's so fond of calling himself? Conservatives take it for granted that he is, while liberals tend to avoid the subject entirely for fear of being thought unserious about the War on Terror. But it's something that ought be brought up and discussed openly.
Which one of us is he spying on?

It certainly isn't spying to monitor this or any other web page. But you cross over into another world when the people who monitor then take the steps to find out who the people posting are. That my friend is where laws start to be broken if the court is no involved to act as the shield for the everyday citizen.

Spying requires that a person's "reasonable expectation of privacy" is being violated without having been notified of that, or when it is being violated over the person's objections. The government monitoring of these posts (is there any doubt at all that agents of the Republican governemnt is not monitoring these posts?) can not be classified as spying as there is no expectation that posts are private.
The real question is whether the government is tracking down individuals, hacking the aliases or strong-arming ISPs to obtain the real identities of posters, and putting copies of "questionable" posts in the government files of said individuals as potential "threats to America and her safety."

I'm sure that they never ever trawl the content here and filter it for threats and "subversion", nor do they ever demand logs from the ISPs along the way (including DU's) for the IP addresses originating connections, and I'm sure they would never try for example to link screen names to contribution records.
The answer on a political level is "oh, another violation of the Constitution, I'll make a few calls". On a personal level, the answer would seem to me to be "who cares, now go fuck off".
What it comes down to is, as long as you're not doing anything illegal, if someone wants to pull a J.Edgar and jack off while wearing the opposite gender's clothes (I was trying to be diverse, but nothing quite matches the image of a fat balding middle-aged Irishman wearing a garterbelt and hose) and reading your URL traces, credit card bills and phone records, well hell, let them. No sense in partaking of the culture of sexual stinginess they represent. Of course if they try to use the illegitimately obtained information to coerce you in some way, then it's no longer OK. But if it's all a bunch of mental masturbation on their part, who cares, let them coat themselves in their own goo, metaphorically speaking.

I'm a frequent flier. I'm also an outspoken liberal.
All I know it that every single time I get on a plane some TSA puke is *guaranteed* to pull me off to the side, open my carry on and sqeeze my nuts. Honestly, I can not remember te last time I boarded a plane and was not checked out by the TSA.
Coincidence, you tell me. One thing I can say for sure, juniors NSA thing came as no surprise to me. I expected he was spying all the time.
