Mexican: My Unborn Child Is U.S. Citizen
Does anybody else think this one is a little over the top, or am I just a heartless bastard?


LOS ANGELES — Lawyers for a deported Mexican woman who is eight months pregnant are seeking her return to the United States to protect the unborn baby's health. They also say under federal law the fetus is a viable human being and thus may be eligible for citizenship rights.

That argument sounds like a longshot to some on both sides of the immigration debate. But in May, a U.S. District Court judge in Kansas City, Mo., approved a stay of deportation for a pregnant Mexican woman after raising, among other concerns, the question of whether her fetus could be considered a U.S. citizen. The judge is reviewing the issue.

That Missouri decision cannot set legal precedent, but immigration attorneys say it may offer them a new angle in deportation cases.

1. What I think is interesting about this case..
is the way it will pit pro-life fundamentalist conservatives against their xenophobic anti-immigration counterparts.

2. If mommy and daddy porked the pie in the US, and given neocon arguments,
that unborn baby IS A UNITED STATES CITIZEN.

They CAN NOT be two-faced about their own policies.

Is the unborn child of a foreign national who once lived in the U.S. but now resides outside the U.S. entitled to U.S. citizenship?

Yes, the child is entitled to US citizenship.

9. Life begins at conception, citizenship begins at birth.

At least, birth determines citizenship in the U.S. I am not sure that is true in many countries. That is, I don't know that other countries give citizenship to a child born there of parents who are not citizens. European countries have certainly been less friendly to immigrants settling there than the U.S. has, having less land and higher population densities. The United States has always been a country that officially welcomed immigrants, though there have always been anti-immigrant sentiments among the American people, not to mention all the prejudice against Native Americans. Today, though, there are reasons to support tighter control of borders and stricter immigration that have nothing to to with ethnic or racial prejudice. We have to be concerned about terrorists, of course, but population crowding is another serious issue.

I really don't feel that baby is a US citizen. From what I remember, it is born in the US that makes you a citizen. If you were born somewhere else, then you can become a citizen.

But who knows what the courts will decide.

OTOH, if I were in her position, I might try it too.
