PATNA, India, July 11 (AFP) - A court has ordered the impoverished eastern Indian state of Bihar to put an end to the age-old custom of low-caste people taking away human excrement for disposal, judicial officials said Friday.

A provincial high court bench in the state capital Patna on Thursday faulted Bihar's government for laxity and asked for a report within three weeks on how the administration is eradicating the illegal and unsanitary practice.

The court order relates to the Bhangis, the lowest rung of the lowest caste in Hinduism, who for generations have cleaned latrines and hauled the excrement away from areas inhabited by the high castes.

Thousands of Bhangis clean toilets across India for the most meager salaries, despite repeated efforts to end the tradition. Independence leader Mahatma Gandhi would famously clean out his own latrine in protest against the caste stigma.

And in 1993, the Indian parliament outlawed the practice of excrement scavenging, although critics say there is little political will to enforce the ban.

Complicating efforts to eradicate the practice is the lack of home toilets in India. Only 31 percent of Indians have "adequate sanitation facilities" with most relying on public latrines or relieving themselves outside, according to a 2000 study by the UN Development Program.

Bihar, India's most impoverished state, is deeply polarized by caste. The lowest caste known as the Dalits, or earlier "untouchables," accounts for more than 40 percent of the province's 82 million people.

State government figures put the number of Bhangi scavengers at 8,000, although a member of India's sanitation commission, G.S. Prasad, said the figure in Bihar was around 20,000.

"As members of this community are still considered 'untouchable' because of their low caste and dirty jobs, they are not allowed to shift to other work and depend on government support for their rehabilitation," said Baban Rawat, head of the Mahadalit Vikas Sangh, a low-caste advocacy group.

A recent survey found that 96.5 percent of Bhangis are illiterate.
