The idea of international law regarding warfare is something the U.S. largely self-defined at Nuremberg. To paraphrase Justice Jackson, the German leaders were punished not because they lost the war, but because they *started* it.
He who starts an unprovoked war faces the consequences. Unless, of course, he's Dear Leader, who has never in his entire stinking miserable life faced the consequences for anything he did.
