The SCOTUS Bush v. Gore opinion basically says, Florida SC ruling to recount ballots violated the 14 amendment and stuck down the Florida SC decision because the statewide recount would not happen soon enough to certify the election before the EC count was certified.

In other words, Florida electoral college votes would not count thus violating all Floridians 14th amendment who cast their vote.

the Court's order of 2/14 and I believe there is another one pending in Ohio Federal court. White may be the name of the plaintiff, but the easy to check is to use Pacer. As far as I know, Pacer only has access to federal dockets and not state filings.

Kerry is quoted saying what you have repeated "I'm glad to say I never lost a case in Middlesex" (his bio on his website), But I can't find the number you give 7000+.

He spent 3 years in Middlesex in the DA's office, 76 to 79.
52 weeks * 5 days * 3 years = 780 workdays in that office (approx)

Which would equate to (7265/780=9.31) winning 9.3 cases per day.

I would think it is likely that the 7265 is total cases in his lifetime, and the unbeaten part only applies to his 3 years in Middlesex DA's office, which is still quite amazing.

If you come up with other info, I'm still interested. 8)

And the quote you have about "I never lost a case in Middlesex" is as much as I can document on that, too, so far.

The overall point, as it applies to the original thread, is that Kerry was the type of lawyer to never go to trial without a solid case, and that would apply to the election, too. He would never have gotten up and just complained about it, without having solid proof in hand.

Your link describes exactly one case that Kerry took to trial as a prosecutor. Commonwealth v. Edgerly

At no point did that article say that Kerry tried or won over 7000 cases. It did say, though, that the entire caseload, including the backlog, in Middlesex County was (drumroll) 7,265 cases. That would include cases pending, plea bargains, dismissals, losses, and cases transferred to other courts.

Kerry boasted that he had cleared 11,000 cases, but that number was 3,735 greater than the entire caseload for the Middlesex County Prosecutor's Office during his time there (plus the cases that were backlogged when he left.) It was at that time that he earned the nickname, "Live Shot."

Well, I think these K/E legal actions are, a) looking forward to '06 and '08, not back to '04 (putting the BushCons on notice about the NEXT fraud they try to pull, and trying to get some rulings and evidence in place to stop them), and b) possibly also meant to undermine the phony "mandate" that the Bush Cartel claimed (as well as gain some Brownie points for the Dems with the grass roots, and maybe assist grass roots efforts at election reform).

Unfortunately, Congress constitutionally holds almost total power over who becomes president. If I read the Constitution right, they can even ignore who people voted for (if there is sufficient controversy about the states' electors) and choose someone who didn't even run. So, no court ruling--not even Sup. Ct.--can overturn Congress' decision on Jan. 6. (And Sup. Ct. should never have ruled as they did in '00. If their decision had gone the other way--FOR Gore, and upholding FLA law--Congress could have intervened and thrown it to Bush, when it got to Congress. That's why Sup. Ct. said B v G was not a precedent. They were on paper thin ice--a one time, unique ruling to install the Bush Cartel, which the Democrats in Congress very unfortunately decided not to challenge.)(They had the votes at that time.)

The Constitution does not make provision for BOTH a president and Congress itself having been chosen illegitimately. It could not have anticipated electronic voting--nor Roman Empire II, with so much power and money at issue (although the Founders tried their damnedest on the latter).

In all justice, Congress should never have accepted the Ohio electors. There were massive violations of the Voting Rights Act, and huge indications of fraud. And if someone could have done it, FLA and some other states should have been challenged on those grounds as well. Also, there was a quite early UC Berkeley study on electronic fraud in FLA, and the exit poll stuff came out and was being published within a few weeks of the election (Dr. Steven Freeman, Jonathan Simon and others). All of this SHOULD HAVE BEEN looked into.

But there was, is and never will be justice in this Congress. The BushCon majority was illegitimately obtained--by electronic and other fraud in '00, '02 and '04. They are lockstep Pod People for Bush. I listened carefully to them all during the Rice and Gonzales debates, and I did not hear a single independent thought from any Republican in the entire debate--what a sorry ass political party it has become!

This is what K/E is up against--and what they WERE up against on 11/3. Not a chance in hell that Congress would give them justice. They could have had a hundred "smoking guns" and it would have made no difference whatsoever (and, in fact, they had more than one at the time--Blackwell's actions, the "terrorist" lockdown, the touchscreens programmed to change votes to Bush). I think they and the DNC bear some blame for not screaming bloody murder over Wally O'Dell and HF Ahmanson gaining control of our election system--and for their support of the Iraq war--but that's a separate discussion. We're talking about what their legal actions might be aimed at NOW. Overturning the election is not possible, nor is impeachment possible with these illegitimately elected Pod People in charge.

After 2000 it was determined that, if all the votes had been counted in Florida, Gore would have been elected. And we know that black votes were disqualified there at a rate 10 times that of white votes. We know that over 6600 Palm Beach 'butterfly' ballots were marked for both Gore and Buchanan and therefore disqualified as overvotes. We know that thousands of uncounted Florida ballots had every candidate selected but Bush (vs. hundreds of anyone-but-Gore ballots). And we know that the official Bush victory margin in that state was under 600 votes.

Proving that election fraud took place would be a great thing. It would ensure that it wasn't able to be done again, and possibly the people who allowed it to happen would spend some time in jail, rather than be promoted. It gives me tremendous hope that the truth still may win in the end.

As for focusing on the future - that's exactly what they're doing. It would sure make me feel better about voting if I knew my vote would be counted. That IS the future.
